This unfortunately is the only way the companies know that you are going to fight them.

    Been fobbed off by natwest again!!!!

    Keep getting a letter saying they need more time and to give them 2 weeks, when the 2 weeks is up i get the same again - getting really annoying now!

    Although I don't know your exact circumstances, this is exactely what happened to me.

    When did you take out the loan? Mine was in 2001, so I threatened court action, and they paid up the full amount. I had however allowed the full 8 weeks to lapse and then I sent the letter in post number 1389.

    No unfortunately but what i advise you remain polite what i would suggest is something along the lines of:

    ref your letter dated .....

    I find most unfortunate that you are unable to investigate my complaint within the set time laid down by the financial ombundsman. I have decided to allow you a further 14 days to process my complaint and reply with a satifactory decision. I have included a copy of the N1 small claims form i will be submitting, reference this claim, if this complaint is not fully satified as of the (date + 14 days).

    I hope that this clairify's my position in this matter.

    I hope this helps although you could add reference's to your original letter but the main gist of it should be that you are giving notice of court action.

    Thank you am flued up and DW is desperately trying to clean house while i lie dying here only joking a trying to recover as fast as possible. I took Black horse to court and they have offered to pay out to me. You should be getting a letter from SECHIARI, CLARK & MITCHELL there solicitors in settlement of the case. Good luck.

  • My husband recently tried to claim PPI back from MBNA on the basis that he is self employed. Got a very patronising letter back which said that as he had opted for it it was his mistake not theirs. At the time the telephone agent suggested it was a good idea to take it and it wasn't until I queried it some years later that he looked into it. According to MBNA the self-employed are covered but in the small print it is only if you cease trading. As my husband works on 2-3 month fixed term contracts in the film industry he needed something that offered cover during any long periods of unemployment. There is no way he would ever have to wind up the company unless he retires. Husband is not that savvy about finance so he asked me to talk to the PPI company who were absolutely adamant that he was covered. He paid thousands into it but would not be able to claim unless he actually went out of business and it seems now he is not eligible for any refund. MBNA finished the letter by suggesting that we were only trying to claim money as we must have 'financial problems'!
