I wrote a letter to reclaim wrongly sold PPI from Barclays for my loan, credit card and overdraft. I was both unemployed and had a disability/illness which would prevent any if not all claims anyway but no one told me. I've had a reply from Barclaycard saying they sent me a policy with 30 days to cancel so its my mistake and therefor am un-entitled to refund. Seems a legit response but thought I'd check with y'all see what you say. Have yet to hear from other 2 Barclays departments but imagine the response will be the same. Thanks for reading!!

I have copied this from my other post as I probably should have put this question here to start with. I'm all confused :rotfl:

They would say that Lisakx my advice and I am sure others will say as well keep going, Barclays seem quite hard to crack it may just be a fob off seek advice from some of the more experienced folk on here they know more than me. Good luck.
Claimed back almost £4000 so far from HSBC for mis-sold PPI
£2083.00 + £242.00 8% interest from FirstPlus and lower monthly premiums:D Studio Cards paid off my account and gave me £125.00 in gift vouchers. £500.00 Barclays.
  • Is it me or is this site really slow tonight ( please don't say it's me) lol.

HMSC Money Claim On Line is the County Courts automated claims service - it's instead of the sending the claim form off to your local county court and it's actually cheaper to issue a claim on line - here's the link www.moneyclaim.gov.uk

Well I did what was reccomended to me and told HSBC that I would go to the Ombudsman if they did not refund my PPI payments on my Credit card as they did with my loan, but they are not budging, bit confused now as it is the same case as with my loan I was not working enough hours to be able to claim if I had needed to, what id different with the credit card, I am now working enough hours so now I suppose if need be I could claim but for 4 years I was not, any ideas I was expecting them to crumble within a week as was suggested to me.
Did you fill in the Financial Ombudsman complaint form and send it with your letter - that's the only way to get them to 'reconsider'

Complain to the financial ombudsman, say you're not happy with their reply send a copy of the FOS complaint form to Barclays 'as a courtesy' they get all hot under the collar then

    Hi all,

Just been reading through the latest posts about court proceedures and the misrepresentation act 1967. Just wanted to know can I quote this act if I am basing my claim on the fact that a was sold a single premium policy over only five years when I thought it covered the entire loan. Also, about the interest being charged over the entire loan etc etc etc. I DID know that it wasn't complusary.

Currently finalising third letter to First Plus and threatening court action. Just want to get my facts right before I send if off.

    All help greatly appreciated.
yes that's right, you could also state that you believe it to be an Unfair Contract Term under the UCCTR 1999. Also, I'd draw up the county court summons form N1 and send them a copy - give them 10 days or you'll commence proceedings, you've got to show you mean what you say or they'll ignore you !!!!
  • Right then guys,

i took out a loan to purchase a car with welcome in jan 04. i couldn't get a loan with welcome but could with advantage finance, although welcome did all the paper work.
after reclaiming bank charges i thought i would now have a go at this as welcome stated that i WOULD NOT recieve the loan amount if i didn't have the ppi insurance even tho my partner was already covered.

i have found the paper work and this is how it goes (sorry no scanner)

    Amount of credit £6000

    term of loan 48 months

    total amount payable £9663,36

    Payable at 301.32 per month

    ppi £2064,44

    breakdown insu £395.00

    rac roadside assi £245.00

    gap insu £395.00

    amount of credit £3099.44

    total amount payable £4773.12

payable in 48 monthly instal at £99.44

i have tried to cancel the insurances as welcome told me i could nut i have been told that i have already paid for them in full so would not benifit in any cancelation. i am a bit miffed about this. i have a email address to send my letter. i just want some advice as to what to say. i was very confident with reclaiming my bank charges. i knew what i was doing. but with this i don't. can anyone help. many thanks becks.

  • I am fighting my PPI with the bank right now. On to Stage 2 replying to the 'you had time to read what you signed' bit. I'm not giving up though.

I managed to get 150 quid out of the building society for paying off my mortgage early fees. Thumbs up to The Portman I made 50 quid profit on the deal too!

Got a few others to quiz yet and I've made it my New Years resolution to fight to the bitter end, it's only the cost of a few stamps afterall. Keep up the pressure, It's worth it!!!
