    Subject Access Request Notice under the data protection act. Send the lender £10 and they have to provide you with all the information they hold on you, which will include documents and correspondence.

    I am now embarking on taking to task my bank with regards PPI on two loans.

    PPI was suggested as being beneficial because I had been out of work the previous 12 months due to illness/injury, beneficial for that reasoning but also to aid in acceptance. This was not the case the PPI was worthless.

    The bank canNOT deny that they were unaware of my situation because they removed my overdraft when I advised them that I was on invalidity and not working!
    Oh the loans date back to 2003/5

    I will keep you posted as the CC element of this bank will be on extremly sticky ground if I win this side.

    To quantify how much you are going to claim you would need all the statements or transaction history as lender tend to provide.

  • GE Money do really seem to be using the same tactics and standard letters don't they?

    I have wrote to them advising that I was not advised that a previous medical condition would not be covered. I also advised I never received a policy booklet. To add insult to injury, I had a long period of absence between March 2003 and 2006 which resulted in incapacity benefit. When I tried to make a claim, their helpline advisor told me that both a: my condition meant I was not covered and therefore could not claim because it was something I had suffered from previously and b: I could not cancel the policy because it was part of my agreement.

    So between March 2003 and 2006 I had to pay my premiums from my incapacity benefit but still had to maintain PPI premiums!

    As soon as I wrote to them instigating mis-selling and inappropriate insurance, they advised I did not have a reason for a refund but would cancel the policy with immediate effect! To add insult to injury told me there was no record of my calls or proof that I had requested to cancel the PPI back in 2003 when I couldn't claim.

    They have now told me that I am in stalemate but in the same breath have asked for proof of evidence that I had this medical condition. Luckily I still had DWP benefit documents from 2003 to 2006 showing long term incapacity benefit, but does anyone know whether this will do any good. I am loathe to let them see copies of my medical file when they would not even entertain me making a claim and caused me severe financial embarrasment. Luckily I never fell into arrears but when you are claiming benefit of £66 p wk and having to pay a monthly premium of £65, it makes things difficult.

    Anyone any ideas what else I can do following Martin's letters to force their hand? Kind regards

    I posted yesterday about Capital One but don't think anyone else is experiencing the same problems with this company.

    What I need to know is...
    I am in financial difficulties and need to write to Cap 1 to tell them to stop all action on my account. Will the ongoing dispute I have with them be affected by my doing so? I would have thought that the issue of their mis-selling of the policy is a separate issue, but need to know if this request will impact on my claim.

    Any help/advice would be appreciated.

    Hey guys im after some advice please, (Sorry this is so long winded)

    My hubby and i bought a car through Direct Auto Financial, we kept the car for 3 years and had paid way more than half the loan amount. So we decided to end the agreement and give the car back, as we had paid more than half the amount we wern't required to pay any money to them.

    Than we got a letter from them saying as they had put on PPI we still owed them £961.55 ! :mad:
    They wouldn't let us take out the finance without the insurance. We were told it was not compulsory. Also as i have rheumatoid arthritis pre existing conditions were not covered. Plus my husband is and was at the time self employed which was also not covered by this policy. Surely this must have been missold to us. I have sent them the template letter from here and have had a reply saying they are looking into it and wil get back to us !
    I have argued and argued with them and refused to pay it so they have now passed the debt onto Direct Legal.
    I am having a nightmare with these bullies. After lots of letters and numerous phonecalls from them i have just spoken to a "team leader" there who was so horrid. I told her as this account is in dispute they can't get involved, she told me as the accounts in both names they can pursue us seperately. She reckons they had a phonecall with my hubby a couple of weeks ago and he agreed to pay £20pwk of this balance (which is a lie). as he hasnt paid it its now in arrears. they have just sent him a solicitors letter threataning to serve upon him a "statutory demand under section 268 (1) of the insolvency act 1986 :confused: . Also threatning to "take away goods from your property" :eek:


    Basically what i want to know is can i claim it back of direct auto and therefore not have to pay them this £961.55.
    Please help me, many thanks in advance all x
    ps they have also put on my credit file that the payments are 6 and 7 months late :mad: which is affecting me greatly
  • Can anyone tell me please? I have written a claim for mis-selling PPI from A & L but still have two years to pay on the loan, can I still cancel the PPI without affecting this claim or should I leave it running until A & L give me their verdict?
