  • hi need some help to recover ppi at capital one
    got copy of terms and conditions using template that states on it that we did not tick box for ppi cover but capital have been charging us since we took out their card in 1997. i again used template to claim charges back only to receive a letter saying that they sold the ppi to me during a telephone conversation, and that i would have received a certificate of insurance which sets out cost and start date of policy. i did not receive such certificate and how would they know what the start date would be i might not have used the card for several months. They also say i would have received a 30 day cooling off period to cancel the policy. Is this still worth following up and whats the best way forward:confused:

    i could really do with some advice as i am being worn down by welcome finance. 2 agreements with them. 1st was car finance which we repaid early this year. the ppi was a single premium policy i'm sure as it was a lump sum and added on to the car finance. wrote template letter to welcome 8 weeks ago saying had been misold because didnt even know we had ppi until checking recently so they couldn't have explained it to us. didn't hear anything back so sent a reminder to them 4 weeks ago and still not heard anything. the next agreement with them was a cash loan which we are now in arrears with. based on the same arguement as the car for miselling that we didnt know we had it until we checked the paperwork. however welcome first replied by saying they believed it hadnt been misold so tough, and enclosed a copy of the agreement which my husband had signed. i wrote back saying although it had been signed my husband didnt even know he had signed for it so it couldnt of been explained to him. they then replied that no was their final answer and if i was unhappy then take it to the fos. i did. i received a letter from welcome last week saying that it had not been misold because my husband had signed a demands and needs statement and an insurance suitability form of which they sent copies. the fos wants to know if i am satisfied or want to carry on with this. do i or not? even though he stupidly signed the forms he still didnt know what he was signing for because he was just desperate for the cash. because of this they couldn't of explained it properley or the fact that it was optional. the other thing is that it is a single premium policy of £957, £1759 inc interest, on a £2000 loan and i have heard that single premium policies are wrong. do we have a case or should we give up? and should i take the first one to the fos because we repaid early and never received any money back for the insurance which i think we should of?:confused:

    After they initially sent my fob off letter I rang up and said I would be taking it further they offered to send me the tapes for £5 - sent cheque off and got tapes and some letters they had sent me in about a week - still waiting for copies of everything I sent them and copy of agreement etc
    When I got the papers / tapes I rang to say stuff was missing and they told me they were looking at my claim again _ without me asking them too - I then got an offer for just less than half the ppi we paid "in goodwill" - I've since turned this down and am waiting for their reaction to this.

  • There doesn't seem to be much chat about people getting PPI payments back from credit cards. Is it because it's much harder to justify misselling on CC's?

    Just wondering since i've just been told by RBS that I've paid £1500 in PPI contributions over the last 4 years and so not sure if it's worth trying to reclaim this or not?

    I have literally just joined and was going to post a question with regard to Blackhorse but it seems i have been beaten to it!

    I too was mis-sold insurance on a loan taken out in Oct 04 (just under 3 months before they were subject to FOS) :mad:

    I was told the loan would not be approved unless insurance was taken, even though i had 3 separate ins policies at the time.

    Seems i have had the same letter as others on the thread, states i was given a leaflet summarising cover, errrrm no i wasn't, they are talking poop! :o

    I'm fuming, they cannot get away with this, total cost of ins including interest was £6015.60!!!
  • i'm having a similar experience with GE capital! I'd love to hear if there's anyone who has had a positive outcome with GE, i'm on the verge of being defeated :confused:

    I will handle each issue ion this page so far.

    Diana, Welcome have anumber of issues with their documentation and the way they set thier loans up. You should get your ppi back and some.

    Michelle you are entitled to the premiums paid plus interest. Accept nothing less.

    Steve, Credit Cards are no different to any other loan. The basics are just the same. First of all SARN them. Get all the information you can out of them including agreement and transaction history. So there is absolutely no reason why you will not get back all your payments.

    Enough is enough. Quite right too, you are entitled to every penny of your £6015.60. If they are not forthcoming, come back to me as I have a few tricks that will not let them off the hook.

    Shop-a-doodle-doo, Dont give up , GE are a doddle if you know which buttons to press and exactly how hard to kick.

    Dont give up, any of you, dont be fobbed off. Virtually every single ppi policy written can be successfuly challenged. dont let them bully you. They have been doing that for years but knowledge is power. Dont leave it just at ppi. Make sure you get the loan itslef checked out. You could walk away with far more than just your ppi premiums.

    Mis-selling is only one issue where you can make a claim on ppi. There are other more fundemental issues that the lenders will have to deal with where vitually every single payment protection plan written could be overturned.

    In such instances the redress will be the full premiums paid plus compensation and there is unlikely to be any time limit.

    What are these issues then?
