    Hi Elise,

    go onto the reclaim bank charges section, there is a calculator on there - just enter the monthly premium and the date paid and it will work out the statutory interest for you.

    write and ask for the information - give them you previous address and ask under the Data Protection Act 1984 for a Subject Access Data Requst (SADR)

    The A&L are at liberty to request you take out another loan if you cancel the PPI but the important point is that in doing so, under Financial Service Authority rules they should not financially disadvantage you (ie they must offer you a rate equal if not better than you're on)

She reckons they had a phonecall with my hubby a couple of weeks ago and he agreed to pay £20pwk of this balance (which is a lie). as he hasnt paid it its now in arrears. they have just sent him a solicitors letter threataning to serve upon him a "statutory demand under section 268 (1) of the insolvency act 1986 :confused: . Also threatning to "take away goods from your property" :eek:


    Basically what i want to know is can i claim it back of direct auto and therefore not have to pay them this £961.55.
    Please help me, many thanks in advance all x
    ps they have also put on my credit file that the payments are 6 and 7 months late :mad: which is affecting me greatly
    Hi if you felt the PPI was compulsory then write (using the template letter) and tell them you were mis sold the whole policy - have you a copy of your terms and conditions when you originally took out the policy ?

    hi there, you need to write to them telling them you were a victim of Negligent Misrepresentation - please see my previous posts a day or two ago on what to put.

    3 weeks agao I found this site and so glad I did.

    I have since Contacted Barclaycard about the PPI over a loan and 2 credit card.
    My hubby is a self employed Taxi Driver and we have paid thousands in PPI.
    I sent my letter regarding a loan I took out with Masterlaon they wrote back telling me to F.... off.
    I wrote back saying I didnt think they gave me a reason to satisfy myself that i was not missold the policy.
    Got a reply quite a cheeky one too I may add;)

    In the rely the lady said " After investigating your case thoroughly I do not believe your client was missold this policy".

    Im thinking what client
    Then she went on and said that I had a loan with mastercard previous to this one and " I refused the PPI" So that makes them right :rolleyes:
    What a load of tosh and now im like a dog with a bone.....

    I wrote back and said that she didnt investigate it that thoroughly when there is no client

    I will keep you posted.

    After saying all of that I received a cheque this morning from Alliance and Leceister for £287 for mortgage exit fees. Wow all I did was write to them and asked ho much I paid...:T
  • I bought a car in 2003 froma local garage. At the time of buying they gave me HP through a company called Close Motor Finance. Not until now have I noticed that there was PPI added totallying £2600 approx. I apid off the car loan in full in 2006. I wrote a letter to the finance company where I was paying the loand and PPI to, received a reply saying I needed to contact the car dealer as they sold me the policy. Letter therefore sent off to dealer who in turn today have replied that I now need to contact the actual small garage that sold me the car as they set uyp the finance agreement.
    However what worries me is that the very last sentence of their response states
    "however we must point out the policy sold was unregulated at the time of sale."

    What does that mean?

    Does it mean I have very little chance of getting the PPI money back?

    Surely regardless of it being bought and PPI sold by the dealer agent, Close Motor finance are still the finance company that issues the HP loan and PPI as I was paying it to them not the garage.

    Any help greatly appreciated as am at a sticking point on this one now.

  • Hey googleman10....soo glad to hear someone else has a pre exsiting...no one else had said anything i was beginning to wonder if i was the only person who had a credit agreement and an illness!.

    What i really want to know is whats the best next step??...i have penned standard 2nd stage letter, but im wondering whether i should call them and ask what they require re; medical condition...im just not sure...

    I know i should carry on, but i am thinking i might not...then that makes my blood boil as that is there aim....one less reclaim!!!

    I am just getting ready to send my letter to yes car credit/direct auti finance when I saw the above quote. I am getting confused with all of this and was wondering if anyone can help.
    Does the above mean its not worth me sending my letter? How can I find out it they were a member of the fsa when I took out my loan?

    It doesn't matter if they were a member of the FSA or not. If they weren't then you threaten to claim through the courts.
