    Hi everyone, Just an update I sent letter 1 to GE Money (Storecard) under the "Company has been fined" and got a reply back saying no the FSA Fine relates to policies purchased after 14th Jan 2005 and my policy was set up in June 2000. Also they enclosed a copy of the contract with my signature on it "accepting the ppi" they also stated that it had been showing on my statements.
    I then wrote back with letter 2 and editted it saying although the FSA Fine related to post 14th Jan 2005 policies I still believe you acted negligently (It was worth a try) I also stated that although I signed it I was led to believe by the sales person that it was compulsory etc.
    They have written back saying they have no way of knowing what took place the day I opened the account in store and if anything like that had taken place I would've been able to call at any time in the 1st 30 days and they would have removed it. They also state that the process they had in place was to make clear it was not compulsory (hmmmmm)
    They then just summarise and say that we are at deadlock and I will have to take it to the FO. I just feel like I don't have a case cause they will say their word against mine :confused:
    Has anyone else had anything similar???
    So far all I have had from other companies is either silence or "on yer bike" don't want to loose hope.
    Hi there, this is a difficult situation as I understand the Financial Ombudsman will not investigate complaints on insurance sold before 2004. The only route open to you may be the County Courts for Misrepresentation, but before that I'd write back and claim the policy sold to you was Negligently Misrepresentated and therefore, under the law relating to the Misrepresentation Act of 1967 the onus is on the 'seller' to prove they didn't Negligently Misrepresent the facts and state you are prepared to take your claim to the County Court.

    on the 30th of October I sent 2 PPI reclaim requests one to GE Capital for a Burton Account and one to Littlewoods for an Index catalog Account.
    I've received the Generic response from GE Saying they are looking in to it and I should wait 4 weeks.

    But i have yet to receive any correspondence from Littlewoods, Which is not unusual as I had previously requested 3 times to cancel PPI on my account but had never received a reply or had the PPI removed.

    I was wondering if anyone else has had any experience in dealing with Littlewoods regarding these kind of matters.

    Hi Dave,

    If Littlewoods haven't responded within the Statutory 8 weeks (inacted into the FSA Regulatory Principles) I'd make a complaint to the Financial Ombudsman 1. for the mis selling and 2. for the fact they have failed to both acknowledge of answer your complaint within the obligatory 8 weeks.

    could use this - gobblegook from the act or just quote Section 52(1) of the Misrepresentation Act 1967.
    • Therefore, under 52(1) of the Misrepresentation Act 1967 provides "Where a person has entered into a contract after a misrepresentation has been made to him by another party thereto and as a result thereof he has suffered loss, then, if the person making the misrepresentation would be liable to damages in respect thereof had the misrepresentation been made fraudulently, that person shall be so liable notwithstanding that the misrepresentation was not made fraudulently unless he proves that he had reasonable ground to believe and did believe up to the time the contract was made that the facts represented were true."

    Sorry if this has been posted already, but I may have missed this

    Hopefully someone can help with this.

    I currently have a loan with Allience and Leister (?) and when taking this loan out, I was basically bullied into taking out the PPI, was told that the loan would not be processed unless I could prove I would be able to pay if I lost my job, or take the protection.

    I took this at the time (as I needed the loan) and canceled the PPI later that month.
    My loan then changed from 60 months to 59 months, but the amount did not change.

    My question now is this...
    Can I claim PPI refund, as I canceled it within a month of recieving the loan, or can I just let this be??

  • I contacted Egg back in August with a view to reclaiming my PPI. I took out my Egg Loan 3 years ago and have 4 more years to run. I sent my first template letter to them and had a reply back after about 6 weeks to say they were looking into this. About 6 weeks ago after ringing them, they informed me that they were trying to locate the call where I alleged I was mis-sold my PPI. Once they have traced it then they can either uphold or reject my complaint. I should have had a reply by now but thought I would give it another week before I chased. They said that all complaints are being dealt with in date order. I suspect they have quite a few! Is anyone else waiting for a reply from Egg? If so I look forward to hearing from you.

    No not had a reply from Welcome or should we say Unwelcome Finance.
    Sent 1st letter 5th Oct (almost 8 weeks ago so gonna send them letter 2 today. Have you heard anything yet and what address did you sent it to (if you don't mind me asking) The branch that I got the loan from aren't there anymore so sent it to head office address on the contract which is in Batley, Yorkshire.

    If the monthly premiums haven't changed it sounds as though the PPI is still included within the loan - you need to go back to the A&L and ask them if this is the case - tell them when you cancelled the PPI and why your premiums never changed - they should have. If they say the PPI is non cancellable and they refer to the contact then the FSA have stated non cancellable / no refund terms are Unfair under the Unfair Consumer Contract Terms Regulation 1999 - go onto the FSA website, type PPI into the search field and the 5th or 6th Item goes into this. You'll probably have to write in to the A&L once you've understood what's happened - I'd copy the FSA document to them as well.
