    Interesting that shortly after I bought this offer (or thought I had), I started to get huge quantities of spam from an outfit called Prizes Planet. I unsubscribed from this (hoping that doing so wouldn't spark even more spam...), but haven't unsubscribed from anything else in the last couple of months. Today I get an e-mail from Mighty Deals saying I had unsubscribed from them so would only get a refund, not the £10 Tesco deal.

    These were never in the orignal terms of the deal. Mightydelas rewrote the terms after the deal ended.

    And it looks like Trustpilot is Cannot-Trustpilot since Mightydeals get any 1 star bad reviews taken down relating to this deal.

    What an strange way to conduct a business!

    As soon as I'm sure i've had the refund, I will be unsubscribing - and I'll be making sure that every contact I have on social media will be made aware of what idiots this company are! Don't suppose that was the outcome they were looking for.
    I got the same email - as it seems so did lots of people, and I definitely haven't unsubscribed.


    Is there any way we can find out how many MSE users have been treated like this and take some joint action !! It would be good if we could somehow stop others being caught in the future.

    The plot thickens, so did this happen after I sent them a complaint emailed via the helpdesk or did it happen after I sent a paypal dispute?:

    We recently incorrectly emailed you to say that you had been unsubscribed from Mighty Deals after you purchased our £10 Tesco Gift Card offer. We made a mistake and would like to apologise.

    We have experienced a large number of duplicate accounts being made to purchase multiple Tesco Gift Cards. In amongst the accounts that we unsubscribed, your account was unsubscribed in error.

    Your account has been reinstated with immediate effect and you will still receive your Tesco £10 for £5 Gift Card redemption link on May 15th. No further action is required.

    Again, please do accept our apologies for any confusion we have caused. It has always been in our best interest to offer our 50% off the High Street deals to genuine customers."

    A promotion on https://www.mightydeals.co.uk stated "Philips Senseo Coffee Pod Machine £44.99 Discount: 55% Worth: £99.00". Smaller text stated "Delivery is an additional £6.99 per item ... Mighty Deals T&C apply". Small text also stated "See Company Website", which linked to Atlantic2U's website.

    Issue
    The complainant challenged whether the advertised saving of 55% exaggerated the benefit consumers would achieve by taking advantage of the offer, because it excluded the cost of delivery.

    Response
    Money Expert Ltd t/a Mighty Deals (Mighty Deals) stated that the Postage and Packaging (P&P) was not included in the discount, which was £6.99, as stated in the terms and conditions, and was in addition to the product cost. They did not consider the saving had been exaggerated as it was the difference between the original price and the offer price. They said the P&P had been taken into account separately and was stated as an additional cost in the terms and conditions.

    They considered that the original price displayed on the deal reflected the item's original price according to most retailers, excluding P&P costs. They gave an example that another large retailer sold the product for £99.99 with an added delivery charge, that Philips set an RRP of £100 for the product and many companies set their prices around that mark, excluding P&P costs.

    They stated they had displayed a link to Atlantic2U's website so their customers could see who was supplying the coffee machines for the Mighty Deals deal. Although Atlantic2U sold the product at £99 with free delivery to the public, the Mighty Deals deal was not processed through the Atlantic2U website in the same way. Instead, Atlantic2U provided Mighty Deals with the product and they set the P&P cost. They stated that Mighty Deals and Atlantic2U were separate retailers and could not offer the same delivery cost options.

    Assessment
    Upheld

    The ASA understood that Mighty Deals were offering a discount on the Philips Senseo Coffee Pod Machine from the merchant Atlantic2U, priced at £99.00 with free postage and packaging. We noted that the price of the Philips Senseo Coffee Pod Machine via the Mighty Deals offer was £44.99 with delivery charges priced at an additional £6.99.

    We noted that the Mighty Deals ad stated "See Company Website", which linked to the Atlantic2U website and was intended to represent the product price on which the 55% discount was based. However, we noted that the ad did expressly set out that the comparison was based on Atlantic2U's product price and therefore considered, in the absence of clarifying information, that consumers would be likely to infer from the claim "Philips Senseo Coffee Pod Machine £44.99 Discount: 55% Worth: £99.00" that the basis of the comparison might be, for example, the price at which the manufacturers (Phillips) sold the product, the price at which the product was generally sold by retailers or the RRP.

    We noted that the advertised discount of "55%" was based on the Atlantic2U product price alone, but that, when compared to the merchant's (Atlantic2U) price, including the comparative delivery charges, the consumer would pay a total of £51.98 for the product and delivery charges, compared to £99 direct from the merchant's website, which amounted to a discount of 47%.

    We considered that consumers would infer from the claim "Discount: 55%" that that discount represented the total savings they would achieve by taking up the deal. We noted, however, that, in light of the additional delivery cost of £6.99 when taking up the Mighty Deals, compared to the Atlantic2U price which included free delivery, the total cost to the consumer did not amount to a discount of 55%. We also noted that the product could also be purchased directly from the Phillips website, which advertised the same product at £100 including standard delivery, which again did not amount to a discount of 55%.

    Because we considered that the basis of the comparison was not clearly set out in the ad and because the advertised savings set out in the deal had not taken account of the relevant delivery charges, we concluded that the claim "Discount: 55%" was misleading.

    The ad breached CAP Code (Edition 12) rules 3.1, 3.3 (Misleading advertising), 3.17 (Prices) and 3.40 (Price comparisons).

    Action
    The claim must not appear again in its current form. We told advertisers to ensure the basis of the comparison was clear, that they did not exaggerate any savings and that advertised discounts did not mislead by falsely claiming a price advantage.

    'Liam' must have sore fingers with all the emails he is sending.

    I challenged the situation via their ticket system, via Paypal and via Top Cashback yesterday and just received an email from Liam saying my Ticket was now closed as the matter was resolved.

    The resolution? That they believe I unsubscribed on the 22/4, so my purchase remains cancelled and I will be refunded.

    I may or may not have unsubscribed from receiving Deal emails, but that is entirely different from ceasing to be a customer.

    I have asked what exactly am I supposed to have unsubscribed from, as their communications are unclear on this, and challenged their decision again, quoting their own T & C's which allow customers to opt out of receiving Deals emails.

    None of the hassle is worth it for a £10 Tesco voucher, but it is worth it on a point of principle and in the hope that such matters do not affect future customers of this and similar sites (and perhaps for the sake of future MSE members being alerted to the potential need to think very carefully before purchasing through certain sites).

    Yes Liam is a prolific emailer - he replies to all my emails with the same lies but fails to read the parts he finds correct.
    What has happened to MD - I have attempted to contact him but suddenly he has got very quiet ??

    If you are reading this thread and haven't experienced Mighty Deals please for you own sakes ignore their marketing - it is all hype!
    The quicker we can get rid of scams like this from the Internet the better life will be - they are like pay day loans - preying on people who haven't got the full facts. They need to be stopped now

    I have also had a response from "Liam", apparently "they made a mistake" and my deal has been reinstated. I'm sure it was a mistake and not related to me pointing out I had complied with the t&c, they were in breach of contract, and I would be referring them to trading standards if they didn't fulfil the deal or compensate me to the value of the voucher (£10).

    I will be reporting them on Monday (to TS) if I don't receive the offer. I won't be faffing about emailing 'Liam'. Nothing yet showing as a refund pending on my Paypal account. I expect to receive what was offered pre changing the t&c's.
    The worst case scenario is it will cause MD some extra work. I have noticed another issue where my credit has 'expired'. The original t&c's stated credits didn't expire. So, breach of contract there also. I'll combine the two complaints.
    It must be the 'silly season' as it looks like I'll be issuing a complaint against an insurance company next week who thinks they can delay cash back payments (via tcb). More work for myself, but equally more work for them! :D
    No payments from financial products from cash back sites? Put in a complaint direct and if they don't resolve your issue, head straight to the financial ombudsman - it costs the company £550 in referral fees, win or lose.
