Is there actually an appropriate answer for FIR's dilemma? Surely, it depends how much is on offer? I'm reminded of this Winston Churchill anecdote.

“Churchill: "Madam, would you sleep with me for five million pounds?" Socialite: "My goodness, Mr. Churchill... Well, I suppose... we would have to discuss terms, of course... "
Churchill: "Would you sleep with me for five pounds?"
Socialite: "Mr. Churchill, what kind of woman do you think I am?!" Churchill: "Madam, we've already established that. Now we are haggling about the price”
No reliance should be placed on the above! Absolutely none, do you hear?

And if asked to open with a price or term...say based on your salary or notice period or some such?

If this is for a compromise ageement he should have access to an independent solicitor at the emloyers expense. This is a very common clause in Comp Ags. illegal in the public sector but private secor can just buy out breaches of contract and buy silence. I would look at 6- 12 months salary as a starting point.

Having said that from an employers perspective I once concluded a compromise agreement for £1.

Blimey, I was thinking £1k first offer, settle at £1500. I'll get NP advice if it ever happens to me :)

I would only accept entering such a discussion if it was going to be paid out officially and above board using phrases like "compromise agreement", "voluntary redundancy" etc and i would want someone other than sadistic boss to be aware of it and ideally conduct the negotiations.

You are basing the amount on loss of earnings primarily, bad treatment etc secondary.

If fir is not going to be working to take time out to recover for bad treatment then you are calculating that length of time on full salary plus . If he is taking a lower paid job and/or less hours then you multiply up that for a few years before he could reasonably expect to get back where he would be if he hadn't been subjected to the situation.

If you start the negotiations, double what you think is reasonable. If they make an initial offer they must be seriously worried, your response is to laugh and ask them to think again.

My pear trees are desperate to burst into blossom. Made me think of Spirit who complemented my endeavours with them.

I'm looking forward to evening drinks on that terrace this year, and morning ones. We have a piece of wood I want to make into a gate but I have lost it, but that can get done soon. I need another gate too, we were given a wrought iron one that I don't love but would do if there was not a hinge stuck in the wretch.
