    Well that was interesting! Solicitor was definitely on our side.
    Upshot is - don't give up the ROW for nothing. Its being bounced back to the purchasers solicitor to come up with a much more suitable arrangement ;)


    Will wait and see what happens now.


    I think that he was shocked that he had been told that is was just a formality of signing the transfer papers only to find that the whole thing had turned in an enormous can of worms.

    It would be more than the solicitors license to try to con you into doing what the neighbor wanted, regardless of who pays.
    I don't respond to stupid so that's why I am ignoring you.

    Slinky it's not the new neighbours who are assuming so much. It's the sellers, as they want it removed so they can sell easily and.for more!!!

    He had been told that, but it was the Estate Agent that told him more than the buyers to be fair. The estate agent was just not passing on information to the buyers. Even when we flatly refused to the estate agent and said we wanted it left as is they told the buyers everything was hunky dory. (after the EA came banging on the d oor demanding and threatening court action if I didn't sign her papers)

    I trust you were more polite to her than I would have been;), as my response to that would have certainly been somewhere along the lines of "Just when did a stranger get to be able to tell me what I can and cannot do re my own house? I must have missed some debate Parliament had last night about it and passed a law on the spot...:cool:".

    Our solicitor told us the right of way devalues BOTH properties because of the legal arguments that can ensue when people start arguing over access. What I meant is that your house would be worth more if your access wasn't through their garden. Your house will be worth more if you sell the right of wayto them and they create a new private access for you- which from the plans looks possible.

    Have a read on the garden law forum. Some of the disputes there are eye watering. Which is why we bought the right of way from our neighbour recently!

    I think this is what i would be aiming for.

    But as in any transaction , start extremely high and get negotiated down to where you wanted to be originally!

    OP, I'd love to buy your neighbour's house, and you could retain your ROW until we put a proper road in for you to access your garden properly.
    Alas, I fear (judging by the price) that it's either too small or too far from work. :(
