    That would be a lovely option. I said that to my wife, then realised that there was the implication of the huge shared chimney breast that sticks out 4 ft into each house.

    If you have a mortgage, your mortgage company may want a say in what happens to the ROW.

    Independent from their solicitor, suggested by them, but it is who we would have used. They have agreed to foot the bill directly.... regardless of whether the sale or change goes ahead.

    Yep, mortgaged. the solicitor is asking for the details of the mortgage, so yes they will have to agree to the change also.

    Show us an aerial photo from google maps or something so we can all see what your're talking about :)
    Take a screen shot and remove the name places if you don't want us to know exactly where you live :)

    Forgot to say - we also have an issue as we have to hve the septic tank emptied each year. The tanker only carries 40m pipe. If its further they have to send out a second man with a van which costs £65 hour from 30miles away.


    Currently on the ROW its just enough. If they change it its even further to the tank from the road.


    Can you have two ROW - one for emptying the tank and one for pedestrian use?

    Just tell them you are happy the way it is, let them start making you an offer you can't refuse. If their house is increased in value then surely yours will be reduced due to the extra legwork.

    Well, I'd be willing to do it, for not too much dosh. In fact, I did something similar with a rental property. Firstly, it sounds like it's just you with the shared access, yes? In which case, only do what will make you comfortable, don't be tooooo nice to new neighbours (we are all nice when we want something, aren't we?).

    So, it does mean losing your short path. It will also involve you losing some of your garden for that long path. And installing an all-weather path, and lighting. And gates. Which, of course, your neighbour would have to pay for. If you like your large garden, then maybe the neighbour would have to lose the bottom 10 feet of their garden to give you permanent access on your own land, rather than a permissive right of way. Maybe you are fat, and might need 15 feet..... which would be large enough for a garage, which they won't object to, so long as you allow them freedom to erect their extension.

    Ok, imagination, much of that, but about four of us did something similar, we re-jigged the garden borders, built a garage block and off-road parking, and all four of us applied simultaneously for permission to re-build our single-storey kitchens at the rear for larger floor area and upstairs another bedroom. Where that house is, off-road parking and four beds is as rare as hen's teeth.... Worked out well.

    Edit.... seen your plans, and I'd tell them no. Unless they'll give you that nice building plot beside their house, then I might.

    massive garden is massive!

    how about offering to swap the right of way for a 10' strip of land down thier boundary (on the right of the picture).

    That way you can drive into your garden from the road (subject to a dropped kerb)?
