If you have fuel and a septic tank, I would suggest that the ROW be moved so that it is 5-10m from the back of their house. Then you don't walk past the window but can still have decent access for utilities.
It gets more complicated, but you could even split it and have general access along the back of the garden (which looks a very long way around!) but a specific allowance for septic tank emptying, fuel deliveries and anything else that needs to be done nearer to the buildings.0 -
Wow, that is a huge diversion. To be honest the only way I would agree to removing the ROW is if they built a road/path across their land to your garden for use by vehicles, along the approximate route of B. Or if they could create and pay for a new road across the land we see to the south.
Other option is that you pay house #3 for a ROW across their garden. They might not mind so much for a bit of free moneyChanging the world, one sarcastic comment at a time.0 -

I'd go for a 3m strip of land along the proposed new route. That way, the septic tank truck can access your land to empty it (not sure if it is possible, but you could run an underground pipe from the bottom of the cesspit so that the taker only has to hook-up and start sucking).
This option also gives you the ability to build a garage or, as it would be your land and your right of way, to divide-up your land and sell par of it as a building plot. You could then sell-up and move to a semi or fully-detached house.Never Knowingly Understood.

Agree, enough land for heavy vehicle access sounds like the right kind of swap.
Also be aware you will have an extension next door sooner or later.
But I'm all for negotiating reasonable changes. (As pointed out mortgage company need to agree)0 -
Would any proposed extension not block light from the back of the house? It doesn't look like there's even room at the back for an extension. Unless it's to be built at the side of the house where the ROW road-part is?0

Wow thanks for all the replies and ideas.
To be honest I don't really want to own the part that the proposed route is on as there are a row of conifers that look like they are about to fall over. They are big and the clear up costs could run into thousands if they come over in the wind.
I like the idea of a proper roadway for the tanker to get in. It already has a dropped kerb / track and there is a large shed / garage that is not on the plan. The base however is not good enough for a tanker to drive on so a proper roadway would have to be installed.
The middle option 5-10m away from the house would be good - that would lead directly to our septic tank! It would certainly make things easier for the tanker, and it wouldn't be any inconvenience to me at all as when I use the path, I have my cycle with me that comes from a shed further down my garden. (the one on the left on the plan)
Re road to the land at the south - South east land is industrial and non negotiable. The land to the south west is mine
(we have animals on it)
Any extension to next door would have to go on the end, though I guess the single story extension that we both have could go up. Would make sense to double the size of the house though as both properties are tiny.
No 3 - don't think this is the route to go.

Can you have two ROW - one for emptying the tank and one for pedestrian use?
Yes, it would be possible to specify a particular use for the blue route.
The problem comes when trying to exercise that right on a very occasional basis, as you can bet that some neighbours would be 'out' whenever you arranged for the tanker to call.
