Help - Right of way question

    What is striking me now is that this house looks to me like, never mind them widening the house sideways, they might be after building a 2nd house on the furthest-from-them side of the garden. Your plan looks as if there might be sufficient width of garden available for them to do that and I'd hazard a guess that may be their gameplan.

    In which case, you would be facilitating them getting a whole extra house worth of profit, minus the building costs, and the price of selling that ROW would have just gone up again....to make sure I got half the profit from another house being built (IF I was prepared to make it possible for them to do so).

    Betcha that neighbours house might be a "stepping stone" purchase.

    We bought our house with no knowledge that a neighbour had an almost identical right of way to yours! The right of way devalues BOTH houses, so if you get rid of it your house will be worth more.

    You can name your price really, as a right of way cannot be extinguished without your permission.

    I would hate to be tramping through someone else's garden anyway. We managed to get our neighbours right of way extinguished just because of the privacy factor- having people wander through your garden several times a day feels like a real invasion of privacy. As others have said, get them to pay for a pathway to be built, maybe giving up a bit of the garden. It will up the value of your house.

    If I were them I would be thinking of at least an extension on that land! That's why you could probably get what you want for it.

    How would getting rid of the ROW increase the value of the OP's property, a house with no access to the rear, except through the house, is always going to be worth less that the same house with reasonable access.

    In a way it wold be better as it would lead directly to the septic tank. I am going to suggest this as an option in the morning art the solicitors. ie [referring to plan] It would be a straight line running parallel with the house / extension rather than an 'L' shape.


    I would prefer this as I would not have to walk past their windows or conservatory (assuming they didn't put any windows in the end of the house extension if that's their plan)

    I agree - the right of way wherever it is increases the value of our house as we then have access to the rear without going through the house.

    It also decreases the value of the neighbours house - especially where it is now. If its at the edge of the property then less so - therefore if I agree to move it to the side of the garden then it must follow that the value of their house increases.

    Don't let anyone push you into making a decision tomorrow, as long as you have a good idea as to what's acceptable to yourself that's what you need to work towards tomorrow morning, see how close you can get then take some time to reassess the situation over the weekend ;)

    IF I were prepared to flog my ROW, then I would go in tomorrow in no mind to agree whatever they suggest on the spot. I would have already decided I would have the weekend "to think about it". I'd be walking in tomorrow with confident demeanour of "I hold all the cards here and I know it" written all over me. Any attempt at pushing me and I would coincidentally need the loo or drop a hint that, as I was in need of a cup of coffee I would have to (regrettably;)) cut short the meeting, as I was "parched" and wait and see whether a strong hint like that got them running to haul out the kettle and cafetiere and make me one.

    I'd be playing it basically for all I was worth:D;) and either telling them straight out "No dice...whatever you decide because I've decided the status quo stays" or, if I felt okay about selling my ROW, making it very clear I was well aware I was in pole position on this.

    Scratches memory and recalls that a common tactic there is to try and "knock your confidence" about being in that "pole position". If they try that one, then a calm "I would be interested to see the facts on which you base your feeling that I'm not in a strong position here" put in suitable language should hopefully knock that one on head.
