Judgement to be announced at 10:30 am tomorrow, will update this thread properly when they let me out of Liverpool, wish I had more time to enjoy the city and of course the pubs...
I'm confident, not as confident as others, but Simon Murray did do an excellent job representing Bott & Co..
Cheers,

I'll make a prediction:
Jet2 / 2 Birds will NOT be allowed the stay to remain.
The case / cases WILL be heard.
Jet2 / 2 Birds will LOSE those cases / case.
Jet2 / 2 Birds will ask to appeal. (This may or may not be allowed)
Jet2 / 2 Birds will apply to the next level of the judicial system.
Jet2 / 2 Birds EXPECT to lose today, however this will not be the panacea we require, just another rung on the ladder. And when we reach the top.... Jet2 / 2 Birds will just buy another ladder.
This is very well put - we seem to live in a country where there is one law for us, and another unrelated law for Jet2! I wonder if they will ever run out of ladders?0 -

I expect he will have been trying to explain what an unexpected flight safety shortcoming actually is.0 -
Hi All,
Well here's my take on today.....
Thank you to Mr Ronald Huzar, that made me feel so welcome and at ease with a Court room situation, I've never been to Court before (well not for flight delay)
Also I must thank Coby Benson, obviously an extremely busy day for him, but he actually was able to take time out to say 'hi' and enquire about my case in Leeds CC. Such an approachable and unassuming chap.
I 've had a fantastic day meeting Ron, Tyzap and Coby.... together with all the barristers and I actually met (sort of ~ never spoke) Tom Bird , flown all the way to see us all from London.
I can't possibly relay a whole days worth of Court proceedings,, so I'm not going to try. There's also the fact that the Judge has not given his decision yet in the case, so for us to argue the case out on here would not be fair. However, it will be tomorrow evening so I'll add more thoughts then...
Well we all knew about Kimberley Allen, but there we're other cases heard:-
Lazare V Jet2.com
Dombovich V Jet2.com
Barnes V Ryanair
Brown V Jet2.com
If your any of the above please do PM me.
We were set in a rectangular Court room with three long benches stretched out along it, 3 rows with about 11 seats in each row, obviously the main parties in the case at the front, the nosy devils like me at the back.
Sometimes proceeding were difficult to follow as it was difficult to hear everything that was said, but I did catch that 450 cases are currently in litigation with Jet2, although their barrister said the potential figure could be as high as 20,000.. Quite an increase from 450 the DJ commented.
The arguments from their Barrister, were nothing new, the number of times I heard the word 'Huzar', I'd be rich if I had a pound for every time that word was used.
A few highlights/lowlights were when the Barrister, read out the infamous NEB Wishlist, like it was gospel.... Of course failing to mention the current CAA advice to Jet2... I even let out a little yelp as he started on that list, the bare faced audacity.
The main defence, well the old arguments surfaced again about limbs, arms and legs, Sturgeon, Wallentin, and it was delivered in such a monotone manner, I noticed Coby yawning at one point (sorry m8).. I think we all did, this basically went on for two and a half hours. The same arguments, that were used in Huzar and absolutely nothing new.
There was quite a bit of time say around 15 mins towards the end, when the Barrister for Jet2 started saying that this 'WINDFALL' (no longer unexpected benefit but a WINDFALL), was not like you were claiming for a refund of a specific amount, it was more like general damages, and thus was a windfall. In a desperate attempt to have the 'stays' kept. The Barrister started suggesting that Jet2 would be prepared to do a Court undertaking to pay interest to claimants if cases were further stayed, there was some discussion about this to and fro, more tomorrow.
I was busy texting the Liverpool Council car parking division, to extend my parking, I didn't expect a 2 and a half hour opening statement from Jet2s Barrister!
After a 45 min recess, Simon Murray the Barrister for Bott, made all the points that I've mentioned above plus a whole lot more, I personally found him much more engaging and went through the 2 and a half hours of recycled Huzar garbage from before, quite clearly saying that there is nothing new, and when will Jet2 accept the decision of the SC. Even at one point saying' Sir, what my honourable friend is asking you to do is to make a verdict in direct opposition to our SC'
At the end of just an hour and a quarter, I was reassured that Simon had done a fantastic job for Botts and of course us. I was pleasantly surprised how confident I felt, I would have loved to have thrown that NEB Wishlist straight in his face, in fact simon pointed out that it was a wishlist and if it held any merit, then the case of aircraft steps/ladders hitting a plane is in fact on the wishlist as an EC, but Simon referenced a case where the airline lost!
Lot's more to tell, I'm really excited and can't wait to hear the news tomorrow.. I'll save more until after the Judgement....
Tyzap, is going to update the J2 thread with his thoughts from today...
Cheers,
