    This is such a high profile case, they wouldn't do that, and they would be laughed out of court if they tried IMHO

They are not a party in the proceedings they submitted evidence, but that's all they did, I would have thought that they could only appeal against the Barnes Judgement which even their barrister said on the day, they wanted to remain separate from the Allen case????

    Yes, it's the Barnes v Ryanair case that is appealed but on the same points I presume?

    The question must be asked tho "is it Ryanairs turn to take the lead"? Maybe just to get Jet2 out of the judges and the medias attention?

    Hmmm, well I'm still a little confused because of this....

    30. In the light of the above I do not need to address the argument advanced by Mr Vanderpump on behalf of Kelly Barnes that her case is not a Huzar type case and should therefore proceed even if the other cases are stayed.

    So therefore if her delay was not a Huzar type case, then what would be the point of waiting a reference to Van der Lans ?

    If my brain is working today, the appeal by Ryanair will be of an operational matter as we heard in Court, so should make NO DIFFERENCE to current Jet2 cases, that have been unstayed post Allen...

    Does anyone follow my drift here, or am I missing something?

    I think I might be able to answer my own question if I give it some thought.....

    I think originally Ms Barnes delay was caused by a tech issue but Ryanair decided to despatch another aircraft to use instead, which lead to a further delay and use the original faulty plane on a different flight when repaired.....
    It was something like that, it was difficult to follow the full details of her delay in Court..

    So what Mr Vanderpump was saying on behalf of Ms Barnes was that if you grant stays because of Van der Lans then you should not grant a stay in her case as her delay was caused by an operational decision.

    Since the 'stay' was lifted there was no need for the Judge to consider this alternate plea.... Back to alternative pleading again.......

    So if Ryanair are insisting its a 'tech' and should be stayed pending Van der Lans, then that by logic means Jet2 could ask for stays pending the outcome of Barnes V Ryanair ???? Or am I just being silly ?

    Of course it's only permission to appeal at this stage, but they might just get it at this level and then well let's see how far this goes for them.

    I concur. It's the weekend - and I'm back in the UK for a nice break.
