    Re: Van der lans - remember KLM, who are the defendents in the Van der lans case, are NOT using it as an excuse for stays, denying payout etc as I had a payout from them last week.
    A useful point to add if jet2 are persisting with the straw clutching exercise.

    it smacks of desperation to have 3 or four reasons. if ANY of their arguments were valid then they wouldnt need three or four.

    I think they make themselves look ridiculous, and not in the same way tim booth spoke about in the song 'sit down'.

    It's called alternative pleading, and if they get the judge to agree with any one of these arguments then they win, here's a simple example of alternative pleading:-

    "Say you sue me because you say my dog bit you. Well, now this is my defence: My dog doesn't bite. And second, in the alternative, my dog was tied up that night. And third in the alternative, I don't believe you really got bit. And fourth in the alternative, I don't have a dog."

    If I get one if them to 'stick' I win and you lose.

    Now of course the arguments presented by Jet2 using alternative pleading are, as you rightly say- desperate.
    Your answer needs to cover these 'further and in the alternatives' using all the relevant case law to destroy each.

    Judgement was handed down on the Thursday so they have till 4pm.
