6 months rent upfront

And do you have a copy of what you signed yesterday? If so what does it say about paying rent in advance? If not ask the letting agency to email you a scanned copy of what you signed, a copy with your signature on it.0

I don't have a copy - they kept both. It said nothing about rent being paid upfront. They won't give me a copy as they are demanding £2160 before I get it.0
-
Why have they kept both copies?
In the nicest possible way, tell the letting agency to Foxtrot Oscar. You do now owe any rent at the moment in time. Tell them to supply you with a signed copy of your tenancy agreement.
I don't know how this has turned into a right pig's ear.0 -
I've emailed asking them, but I doubt they will send it. They are disputing it saying the contract was signed ' on the understanding that... '.
I was also told 'we do this every day' and ' do I really want someone staying in a property that can't abide by the contract?'. I haven't broken the contract!0 -
The contract was signed on the understanding of what was WRITTEN in the contract, not whatever verbal diarrhea the letting agency was coming out with at the time.
Can you go into the letting agency and collect a copy of your tenancy agreement? £10 says your agreement doesn't say anything about paying the rent 6 months in advance and the LA has messed up and is now trying to cover their tracks.0 -
Contract says absolutely nothing about rent upfront. They tried to tell me on the phone just now that it was EXPLAINED to me when i originally signed the contract that pre payment would be required for at least 12 months as I'd been out of work, and they say I've not been with my employer for long enough for a reference to be worthwhile.
They took my £60 to 'draw up the contract' yesterday, and refuse to refund that if I am to be turfed out.0 -
It doesn't matter what the letting agent think may or may not have been explained to you. What matters is what the tenancy agreement says. This is why it is imperative that you get hold of a signed copy of your new tenancy agreement.
How will you be turfed out? You've received no notice that the LL wishes to start the process of gaining possession of the property. Even if you do receive such notice, it on its own won't end your tenancy, the LL or an agency acting on his behalf would have to go to court to get an eviction notice.
This whole situation is a molehill turning into a mountain. If the letting agency refuse to give you a signed copy of your tenancy agreement then write to the letting agency asking for the contact details of your landlord which the LA has to provide within 21 days.
Your contract is with the LL not the LA. The LA is employed by the LL to act on his/her behalf so if you don't get anywhere with the LA go to the organ grinder and explain that you like living in the property, you've signed a new TA which the LA is refusing to give you a copy of, and that you would like to continue living in the property.
It would be daft of the LL to get rid of a paying T and face a void period for no good reason.0 -
They were the ones that contacted me saying they wanted me to stay, and now they're moving the goalposts. I'm not even sure why they need 6 months rent now when I am only just coming into month 5 of the original tenancy.
They also say that they are the landlords.0 -
Who does your tenancy agreement say the LL is? Does it give the letting agency's name as the LL or is there another name written in your original TA?0
-
Has the letting agents name0
