    It's been fairly widely reported that it was the banks who initiated the test case. In effect it is the banks that are challenging the OFTs view that the charges can be assessed under UTCCR. And this seems to have been comfirmed by the fact that the banks made their submissions first in the test case hearing and it was for the OFT to reply.

    hi, ive been claiming from to banks a&l and halifax since jan 07...still waiting because of this test case:mad:
    the reason 4 my reply is my halifax account acrude more charges but i stopped payin money into the account ,,so the charges kept being piled on until it reached over 300 quid, i to got the threatnig letters from solicitors, but i did nothing.i checked my online account 1 day and they had closed it down with out telling me!! but cancelled all the charges:rolleyes: y would they do that if they thought the charges were fair:rolleyes:
    sorry to babble on but also a&L have lowerd there charges quite a bit from 34 to 25 pound..that just tells me

    the court case is over but the judge has not made up him mind who has won. When he does both the OFT and the Banks will not like it and ask another court to take a look at it and make another decision. That decision could either agree or disagree with the first judge. Once the highest court has heard the case which could take 2 years then what that judge at the top says is the one that will be used as law and the banks will make a decision at that moment in time.
    I hope that is simplistic an explanation as possible even if the post may seem a little patronising(I hope its not).

  • My bank credited me with approximately £630 as a gesture of goodwill. Even though this was done, how does my situation stand with claiming bank charges??

    Regarding the possible 2 year wait for the appeal - with the 6 years backdated allowance, surely some people will loose the right to claim 2 yearsworth of charges?

    Not if the claim was issued at court within the 6 year limit. :)
  • That is the advice that maybe given(not sure if MSE do) because with a stay on the claim, 6 years is from the date of filing the claim.

    Right, I see. So if you had loads of charges 6 years ago you need to apply to court asap.
  • I was told when i put the claim in for my bank charges that everyone will be charged £25.00 a year just for having an overdraft wether i use it or not. If you want to exceed your limit you will be charged, and if you are a first time customer wanting an overdraft you will be charged. I never had this before and the bank people i have spoken to told me they are doing this because of everyone claiming back there money. Is this true?
  • Prairie, you are speaking to people working for a bank. I work for a bank and that is nonesense. Which bank is it? Maybe name and shame em cos if a bank is telling its staff to tell you that when you want to claim charges back then it is quite frankly shocking. Advise NatWest are told, that if someone has an OFT/unfair charges case is to give out the address to write to or get the person to write to the bank directly and we will forward any correspondence to the correct department.
