    Back in May last year I was all ready to take the case to court then heard about the test case so decided to lay off....didn't expect it to go on so long!

    If the case was found to be in our favour, would I be able to carry on with my case by sending a letter to the bank, advising them I held off simply because of the test case?
  • Nothing stops you from sending a letter now.

  • I have started small claim court action which has now been stayed. The problem is the bank keep updating my credit file default information. Despite all this startng before they defaulted me. Question is: does this fall under the agreed waiver with OFT? Financial Hardship. As I can't get credit anywhere because of the default.
  • If you are at court stage the FOS will not look at the case because as soon as you say you have a case stayed they will stop looking into it. With regards to business as usual for the banks, until the ruling comes out the charges are lawful.

    I know nowt stops me sending a letter, I was just worried that it may harm my case with the fact that a lot of time has passed between my final demand and actually logging a case!

    what is happening? Does anyone know how much longer the banks are going to be holding onto our money for? Its a disgrace, i applies for my money back a year ago now, is anyone else as frustrated as i am? When will these idiots pay up!!!!!!!

    I'm in the same situation, I started mine in Jan last year but have got know were as the court case was stayed in October.

    I have however received a refund on a credit card and they have actually refunded the amount twice by mistake, lets see if they notice.

    I requested a refund of credit card charges from Lloyds TSB and have now twice received letters saying they are investigating but it will take another 28 days. Typical for Lloyds........

    judgement is due sometime in july, banks solicitors do not want it leaking before then,judge says his judgement could make history. Rumours flying around are that once testcase results are known it could take upto 4 years for appeals and re-appeals to go through.:confused:

    Its true that it can take a few more years for appeals / re-appeals to go through, but if the judge agrees with oft and the not the bank surely he would be able to get the fsa to remove the stays.
