  • THe test case is now over, and the judgement is now being awaited. NatWest will have a response sent to you from the Customer Response Unit, which will log the case and tell you that it will be dealt with after the judgement of the OFT test case.

    end of July. a year since it started,and this is only step one. 2 more steps so two more years i suppose. thats halved the statutory 6 year limit for the banks. they must be laughing .... ummm ..... well all the way to the bank :-S

  • I have been trying to reclaim my business bank charges from TSB however a court in Northampton have "stayed" my claim until the High Court case is decided. However I thought business accounts were not affected by this as they will rule about personal accounts. Can this judge legally do this and how can I go forward from here? I live in Scotland and for some reason an english solicitor is dealing with this because I got a company to deal with it for me. They have had my claim since June 2007. Help!
  • JUst a quickie to ask I live in Leicestershire but my bank that I am claiming from is in Lincolnshire. The Lincolnshire courts are hearing cases still but Leicestershire court is awaiting the outcome of the test case. Do I go through the Leicestershire court or the Lincolnshire one where my account is??

    I'm getting married this year and my Mum owes me £120 for the court charges!!!!

    I could really do with that money! So does anyone know when we're likely to find out the results? Has there been any sort of initial outcome? Have the banks begun the appeal process?

    I still don't trust the OFT to "act in our interests" after all, they wouldn't even listen to consumers and made damn sure that no campaigners or any of those affected had a got an opportunity to air their views & concerns..

    Firstly, they claim that the test case was prompted by the overwhelming number of claims against banks for bank charges believed to be penalties. So, why didn't they test any of those cases? Isn't that what a "test case" is?

    The OFT test case pretty much has nothing to do with the vast majority of claims made to date, in that the principles in question are not the same.

    If they really were serious, they could have rigorously compared the two in court (the original to cover our administration costs Vs Fees for a service). Surely the first thing to have done would be to address the legalities of all the thousands of cases over the last 3-5 years first. After all, it is those cases that the OFT say "prompted" this test case.
    Once that was settled, then get on to the arguments over the new T&Cs and examine how or if the two are any different.. It still baffles me how services that were introduced only weeks ago can be part of the core terms of an account that was opened 10 years ago.

    It is the failure to address and fully include the original principles and the flat refusal of the OFT to even listen to the concerns of those they are are supposed to be representing that still makes me suspicious of what the actual intention of this case is.

    No. This is a red herring. Banks cannot take an assignment or charge (mortgage) over benefits. There is nothing in the benefits rules to stop them from applying fees and charges to accounts to which benefits are paid into.
