hi- i received a letter from the courts back in august 07 telling me my claim be stayed. what i am wondering is there a time limit for a claim to be in court without being seen. what worries me is my claim just vanishing.

My case which was due at court in October was given 12 months stay, to reviewed again after 12 months.

    Hope this helps you..
  • You have said that cases can go through quickly if the complainant is facing financial difficulties and you've cited different ways that this would be the case, but you haven't included the fact that the charges incurred may be causing the financial difficulties in and of themselves.

Because of the bank charges I now incur each month I can barely afford to cover my required bills (e.g. mortgage, council tax, utilities etc), and still have money left for food for the rest of the month. I currently dare not spend more than £20 per month on food for myself. Would this count or am I just kidding myself?
  • Is it correct that if you claim your charges back the bank will close your acc?? I have a personal acc and joint acc with the bank i wanted to claim my own charges back from. Would this mean that they will close my bank and my joint acc?? Can they do that. I am with the Natwest and would like to know if this has happend to anyone previously as i wont apply if it has.
  • ^^^I don't think the bank can do that Roscoe but to be on the safe side I would set up new accounts.

I haven't sent in my first letter yet (hoping to finalise details over weekend) but I set up new accounts today.
  • So people would still recommend claiming against the banks and sending letters in despite the Court Case going on?

You just need to let the court know the claim has been settled to your satisfaction.
