    I don't have the order on me as I am at work but it basically says

    It is ordered as the defendant did not turn up that:

    1) The case be set aside with liberty to re-open

    2) The claimant be given until the 21st September 2007 to instruct the court to restart proceedings or the case will be closed.

    This is all it says, when I spoke to the judge he said that A&L said that they would pay within 28 days. He was very nice and said that if they didn't then he would allow me to re-open the case as this would probably nudge them into paying. However, this was before the announcement so things may now be different as the order does not mention any offer having been made.

  • My bank has made me an offer of £761 but the charges total £895 without interest. I would like to except this offer however the bank has demanded I pay of my whole overdraft as I haven't paid money into the account for several months. My overdraft amounts to £631 and they have passed it on to a debt company the bank is kindly going to take the £631 out of the money and send me the rest. However I am in the process of claiming bankruptcy and I have included this debt already. I explained this to the bank and they told me I had no option other than to refuse the offer and wait for the results of the test case.

    This would have happened no matter the recent waiver to be honest. All of the banks will pay any monies reclaimed into the account it is claimed from and if that account should be in debt or with a DCA then the account will be opened to pay the money in.
  • with the reclaim in bank charges, I used to bank with the woolwich until a few months ago, when the woolwich tranfered my account to barclays, so do I send my reclaim to barclays with my old woolwich account number????

    I received papers from my banks solicitors yesterday as they are intending to defend my claim for just short of £4000.

    They have made a request for further information including the dates and amounts of charges which I have already provided in my initial letter to the bank. Is this just legal delaying tactics?

    I am now not sure how to proceed and would appreciate any advice.

  • I was offered a settlement on the 16th July 2007 and sent my acceptance on the 17th July 2007.

    I have since been informed that the bank did not receive my acceptance until the 1st August 2007 ( very coincidental ) as the court case was the 27th July 2007.

    I have now been informed that they will be sending me a new acceptance letter for me to sign and I should have this within 2 weeks but what I want to know is, is the letter to be with me 2 weeks from the 27th July or when I spoke to them on 6th August 2007.

    Any help would be appreciated

  • I'm unsure about whether I now need to open a new bank account if the banks are suspending all dealings with bank charges.
    I have already written a letter to the bank and have received a list of bank charges. I was going to open a new account this month when I sent the second letter claiming the charges back but do I need to open a new account now if eveything is on hold?

    After keeping me waiting for ages, Barclays have sent me a standard letter saying they cannot deal with my case until things have been dealt with in the courts. Don't know where to go next and am not happy. It's only £600 but would mean a lot to me as I'm skint. Not impressed at all!:mad:
