I've received a letter from the court in the form of General form of Judgement or Order. It states the following:-
    1. The claim form is hereby struck out as it fails to properly particularize the alleged breaches on the part of the Defendant.
2.Permission to the Claimant to file and serve by 4pm on the 30th August 2007 a claim form which:-
    a. sets out each and every alleged breach on the part of the Defendant.
b.why such breaches are actionable in law and entitle the Claimant to address.
c.bears a signed statement of truth.
3.Permission to the Defendant to file an amended Defence by 4pm on the 20th September 2007.

You need to go back to the court and ask them why, they are the people who will know.

we did and they said it was the judges decision and only she would know. (we rang them twice) and there was nothing they could tell me. and of course she was not available for telephone calls.

Sorry if this is a repeat of other qns. When people write about mortgage fees do they mean the fees attached when you end therelationship early. I was tied into my mortgage for 4 years but moved and bought another property after 18 months. I had to pay about £3500. Can this be claimed back?

In short no, but check the Mortgage Board for Early Exit Fees.
  • Having initally requested a statement of bank charges in June I still hadnt received a reply by October. After weeks of excuses ie: my letter had been sent to the wrong dept etc etc I was informed the most they "were allowed" to refund was the largest amount accumulated during a 6 month period. I therefore accepted £340.00 "in full and final settlement"
Am I still entitled to reclaim any other charges as the 6 month thing was a deliberate lie?
  • is there anything else i can do?
  • Help please!!!

I have a claim with Lloyds which had court date of 12/9 with Southend court. Rang them today and have been told that judge has decided to stay the claim until after the test case. (Even though SC&M had advised me last week that claim would be continued due to me having a court date).

Anyway, I have had bloody awful last couple of years so think I would qualify for 'financial hardship' argument, but please if there is anybody that could help me with this I would be extremely grateful!

Cut very long story short, split up with partner last year, had loads of debts caused by him, and then found out I was pregnant. I had our 3rd child in April, repossessed in June, am on income support and have agreements of minimal payments to credit cards through Citizens Advice Bureau.

I have just had a settlement with Lloyds for £2,400 just before the OFT announcement, I have a 2nd claim with them for £4,000 which has just been stayed. This is the claim I would like help with if possible. (I also have an Abbey claim where had just sent 14 day letter to them, and also claims to do for Barclaycard and Cahoot).

I have had rough couple of years, and never ever been un this situation in my life. The bank charges are a way of me getting back my independence and a chance to clear some debts, rather than going bankrupt.

If there is a moderator, or anybody that can help me with this, I would be really grateful.

    Thanks in advance (hopefully)

    Karen
