Its great that somany people are taking the pi$$, but id be more concerned that my card had been cloned, theres no way they could have taken the payment twice.

unless the op put their pin number in twice

    Contactless payment?
Common sense?...There's nothing common about sense!

I still have had no refund and NO CONTACT from the store. I have sent another e-mail and had the same generic response.

As I said two days ago... you need to call in at the store.

Emails are to easy to ignore.

Perhaps you could try a phone call to the actual store instead.

Be careful though, as someone else has said, you are in great danger of spending more money than the claim is worth.

As we have actually only had one working day since you started this thread, my revised opinion is to wait until next Tues/Wed before dragging yourself down to the restaurant.

Can't see emails working well for a franchise arrangement. Call or visit the store.

From your posts, I'm a bit confused as to whether you were charged twice the money in one transaction or two transactions (i.e. 1 entry for 7.98 or 2 for 3.99)

Er, actually, it isn't. That wasn't a Direct Debit payment.

Oh, ok. The direct debit payment wasn't a direct debit payment. Thanks for the clarification.

I wouldn't be 100% sure that the DD guarantee would apply in this case.
TBeckett100 would have given Amex permission to take the money using the direct debit that they set up and normally when amending or cancelling DD's, notice usually need to be given a few days in advance of when the next payment would be due.

As they made a payment on the 29th Jan, there was only 2 working days between that date and the date the DD payment was taken so it may well have been too late to stop the automatic payment especially if TB hadn't informed anyone that the DD needed cancelling or amending.

I see your point, but I think the DD guarantee would still apply, as clearly taking the payment twice, albeit by different methods, is "an error".

In any event I think the bank would refund regardless.

the clue is in the name Direct Debit Guarantee. if any other method is used then the DD Guarantee would never apply

I disagreed with you as you stated the DD would still apply if payment taken by different methods
