sorry to hear that you damaged your car and it is understandable that you feel annoyed, but as has been said it is only you that is to blame for the damage to your car

I agree that it is wrong that the parking garage allowed more cars in than the max capacity and it could be considered a safety issue due to restricted access but i don't think you will have any joy fighting them

I was in the trafford centre manchester and inconsiderate parking is always a problem and the centre owners do nothing about it, yesterday i was in the car park early and made sure that i chose a space where regardless of what other people did i knew i would get out when i wanted to

I would say that on this occasion you will have to cover the cost of your repairs but if it makes you feel better then send in a letter of complaint to the car parks owners and see what they have to say in their reply

I think you should learn from this and make sure that in future you can get out of the parking lot regardless of the actions of others, if you cant do this and do get blocked in then report it to the car parking staff and ask them to deal with it

Take the q7 back. It's clearly bigger than your parking abilities. no wonder there's gridlock around many London primary schools!

PS. your car has devices to make sure you don't rub rear doors on pillars. they're called mirrors.

Pps. my 4x4 looks better with some mud and a few dents. maybe yours will too

10" longer and 8" wider than a Mondeo estate?

As said only hindered by it's high driving position, I had compared it to the Golf when I looked.
I beleieve the OP would have had the collision with whichever cr they were driving at the time, because they didn't look and check if there were any obstructions before concluding the reversing manouvre.

Given the number of people who come looking for car advice and do not give a clue as to what they drive, the OP came straight in with "I drive an Audi Q7!!", when the brand/type of car didn't really matter a damn.

  • If I were the car park owner, I would strongly consider taking a claim against you for reversing into my property and damaging the bollard

Anyone can answer my question, if a overloaded bus has a accident, then whose fault?

If the overloaded bus isnt moving, then there is no accident to be had.

If the overloaded bus moves and has an accident, then its the DRIVERS fault.

OP, as you knew there likely wasn't enough room you should have sought a member of staff, they may have been able to move a car for you. You scraped your car because you failed to stop when it was clear your vehicle didn't have enough room. Your actions caused the damage on your car, yes it's annoying, but it's just a car, I hope your driving skills are far better when you have children in the car.

    Look at it like this.

You're driving in a country lane at 45mph. You come around a corner at a "safe speed" and there is a tree trunk lying in the road where it shouldn't be. You hit it.

You can't blame the council, mother nature or Lord Dendro. It's your fault because you're moving and the tree isn't.

The pillar didn't move - you did. If it wasn't safe to move then you should have waited until it was.

This is really a naive comment to make, and really doesn't help to backup your views about this. depending on the situation, the land owner could be held liable for damage in such a situation. The land owner would have to show that they had taken steps to maintain the trees, to remove any branches etc that were at danger of falling, failing to do so would put the blame at their feet.

If the tree branch landed on a stationary car, yes.
But if a moving cars hit a stationary branch? No. That is 100% the driver's fault, whether the branch should have been there or not.
