fullfilled by amazon prime

Advice needed please,i bought some items off amazon this morning at what i thought was a promotion/bargain or a possible misprice,im a prime member and items have been dispatched for delivery tomorrow(sunday),i just received this threatening email from the amazon prime seller as its a fullfilled by amazon order.

For your protection we recommend that you only communicate with buyers and sellers using this method.
Dear Customer

Firstly, I'd like to apologise for the disruption this email may cause.

We experienced a problem with Amazon UK yesterday at about 18:00GMT and worked to fix the original issue by 20:00GMT.

We continued to work over the following few hours in conjunction with Amazon to revert any incorrect prices to their original prices, caused via the Amazon system

We have received communication that Amazon will not penalise sellers for this error, but have requested we contact buyers and ask them to create a return request to return the stock back to amazon.

We are continuing to work to identify how this problem occurred and to put measures in place to ensure that it does not happen again.

We've been in business for over 4 years and we've always taken pride in the levels of service we provide, so everyone here is devastated and disappointed we experienced this problem. Unfortunately, our inventory lost over 10000 units within a space of 2 hours, which couldn't be prevented. This will result in PremiumBrands4Less entering liquidation as a result of this pricing error by amazon.

We understand that you think you may have grabbed a great bargain, but we have instructed amazon to revert the prices to our usual prices and recharge your card with the correct amount owed. We would like to offer customers a grace period of 7 days to create a return request and return any stock incorrect priced and dispatched. If this action isn't carried out, we will seek to recover sums owed

1. By recharging your credit/debit card
2. If funds are not available, passing to a debt collection agency
3. Informing experian and getting your address added to the mail order black list

We would like to urge customers to be honourable and honest during this Christmas period and not take advantage of a small business, who cannot afford to give away its £100,000 inventory for under £100. This will create a number of job losses in the run up to Christmas, due to the behaviour of a select number of customer.

I again reiterate, the products were not Amazon Inc, products, but were ****** owned products dispatched on our behalf by Amazon Inc.

now as ive paid for these items using a amazon gift certificate have they any legal right regarding this?items will be delivered sunday,i spoke to amazon who told me to refuse delivery but why should i,ive paid for items and amazon have despatched them so the contract as been fullfilled,surely amazon are liable,any advice welcomed

  • What did you buy and at what price? Sounds to me like you got a £1000 item for £1, or a £100 item for £0.01. This makes it pretty clear that it was a mistake. They probably won't have the right to charge your card for the extra money, but they may win in court if they took you since as you admit in this post you thought it was a pricing error.
  • no i never got £1000 worth,that was the overall picture of numerous customers,i entered into a contract at advertised price and amazon despatched items,to me the contract as been made as goods have been or to be delivered

    I'd have no sympathy at all for a company that behaves in this manner.
    recharge your card with the correct amount owed
    You don't owe them the price they should have charged.
    If funds are not available, passing to a debt collection agency
    There's no debt to enforce.
    Informing experian and getting your address added to the mail order black list
    I know what Experian's response will be, the second word is 'off'.

    Of course, it's the customers fault these clowns can't run a business. Classy, making out that you - and not they - are responsible for their employees.

    Usually in these situations the seller realises before sending stuff off, and cancels before the contract is formed. I've not read the T&Cs here but my money is on despatch of goods being the point the contract is formed.

    the order was from a 3rd party seller but is fullfilled by amazon and is eligble for amazon prime
  • I agree the tone of the email they sent is very bad, and is very much a bluff. I don't know how the 'fulfilled by Amazon' model works, but it sounds like the 3rd party doesn't have much control over when the items are sent because they are stored in Amazon's warehouse. Presumably the 3rd party set the prices though, and they have made a mistake with that somehow.

    It's going to be a pretty expensive Christmas for them.

    Doesnt apply to obvious mistakes.

    In those cases the contract is void.

    If anything would make me more likely to keep the items, it's this. If they go under you won't get your money back.

    I had a look on the Amazon selling boards to see if there is widespread discussion about a pricing glitch. There is one seller who has reportedly sold just over £4000 worth of mobile phones at £0 , but no other reports of issues.

    I would usually be very sympathetic of a seller in this situation, but the tone of the email concerns me- it is overly aggressive and makes threats it cannot possibly follow through. Without any proof for my gut feeling whatsoever , it seems to me that they have made a mistake and rather than admit it and try and work out a solution with their buyers, that instead they have decided to bully buyers to cover up their own incompetence.

    We experienced a problem with Amazon UK yesterday at about 18:00GMT and worked to fix the original issue by 20:00GMT.

    So they are saying this happened at 1800 friday evening til round about 2000 i bought these items at 7.46am saturday morning
