  • @Toiletduck -

I was going to offer some advice but due to your post 22 - sorry I am out of this one

    Sorry I dont understand?

Have I committed some sort of unknown faux pax? I had a look on the pepipoo forums for similar threads as recommended and someone on there is suggesting it as a sensible action in this scenario?

No - it is not down to you -

it just would not be advisable, appropriate or fair for me to offer advice on any such thread at the moment.

I will leave you in the capable hands of others who can assist :-)

It is very very strange that before Peel holdings bought this road and it was a public highway there was never a congestion problem.

There still isn't now, except for the one they are causing on Dunlop/Hale roads because of the carpark charges and the scammera van.

Just looking on pepipoo on VCS tickets now they have moved to IAS. Someone has suggested paying £16 and using

    http://www.parkingticketappeals.org.uk

Are they reputable? Perhaps worth it given my wife wont put up with the hassle.

I am out too - can't comment nor recommend.

Well clearly Abigail Titley has not read the decision of the IAS in the case of VCS v srs1311 where you are allowed to stop and park on a red route for a fee of £100.00.

Of course, perfectly normal as a contract, in the lala land of IAS.

  • Ok, so I will email the template response to VCS and see what happens.

    A few questions:

d). Your 'Notice' fails to comply with the POFA 2012 and breaches various consumer contract/unfair terms Regulations.

How do I check this with my PCN or is it a given for all PCNs?

Does the template need tweaking in any way as the contravention is "Stopping on a roadway where stopping is prohibited"? That said its a Parking Charge Notice at the top of the page so perhaps its ok as?

Finally if I email the appeal, does it matter whos email account it goes out from? If it goes from mine but my wifes name is at the bottom is that ok? Or should it come from an email account in her name?

    Regards

Leave it in, don't worry about it. Anything you put in your appeal needs to be dealt with by the PPC. Don't do their job for them!

Leave it as it is, if you start to change things there's the possibility you might inadvertently identify the driver - which is not what you want to do!

Why not create a new 'throwaway' email account with Google or Hotmail, with a gobbledygook user name just for dealing with the PCN?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

OK sounds like a good idea.

I will send it off and be back here with the response in the new year.
  • So I tried to appeal using a free email address as suggested and this happened after a few days:

This message was created automatically by mail delivery software.

A message that you sent could not be delivered to one or more of
its recipients. This is a permanent error. The following address
    failed:

    <cpo@vehiclecontrol.co.uk>

    Reason:
    delivery retry timeout exceeded

So the email address they supply to appeal to doesnt even work?

All the more reason to ignore. PoFA does not apply, they have lost nothing, contract may be iffy, IAS appeal system FUBAR, they are unlikely to try court.

Let them spend their money chasing you. If you want to get your own back go to Trading Standards.
