Bank Charges Test Case Article discussion

I requested a history of charges and sent your template letter to my bank, but just as I posted it I heard the news of the hold (tough break - I know!!)
But my questions are, where abouts will my claim be and, obviously depending upon outcomes of court cases, what should I do next?
Do I just sit it out as I have been, or is there anything proactive I could be doing?
Cheers,
Rob :cool:0 -
I have two cases sitting in the Claims Court against two separate banks (Lloyds TSB and the Co-operative Bank) - this further delay on OFT's part is totally unacceptable! To say that they need more time is an understatement of the year! They have had (as have we in waiting) 12months - WHY the further delay exactly?0

Because litigation takes time. 12 months to have a High Court trial and appeal to the CA is extremely quick. I very much doubt any other country in the world could offer a quicker judicial process.0 -

Or -in plain English - the lawyers need time to trouser the fees, which will be excessively high given that we are talking about Govt vs Banks (in effect). Both have almost unlimited resources at their disposal.
The OFT case has been a complete shambles. They've rolled over on almost everything that matters and, by interfering, have jeopardised many individual claims. They should, at the very least, remove the 'stay' from cases being held up.0 -

Utter rubbish. Neither has unlimited resources - government departments are subject to National Audit Office investigation and banks will have budgets.
Lawyers fees will have been benchmarked. They will also be subject to 'taxation' upon conclusion of the litigation. The days of litigation being a money machine for law firms are over since the Woolf Reforms.0 -
hi
The judicial system isn't the hold up in this, it is the OFT's inability to decide on a fair bank charge. their report has been ongoing since early 2007 and is still not complete, despite missing many deadlines already the last of which was to have it finished in time for this latest case management conference.
with regards to bottomless pits of money, this isnt the case the OFT's budget is only £70million of which £35million is spent on help lines and supports for consumers. the banks of course have the use of our billions of pounds of bank charges available.

I have already made a claim, the bank put money in my account as a goodwill jester but I never accepted the amount and phoned them up to tell so the guy up there offer still never accepted, so he said that was the best they can do so I wrote to the oft and they are persuing it for when it all comes to light again. BUT i was wondering if you could claim again as I have went over my overdraft a few times again since,so can you claim again from the months you have last claimed for until now ?0
