I have a question about using the "Hardship" approach to having a Stay lifted/refused.
I am currently off work having suffered multiple pulmonary embolisms recently and am due to go down to half pay. At that time my family would suffer severe financial difficulty and will not be able to meet basic debts, mortgage, food, fuel etc. And i was wondering if i would be able to use this reason for a stay not to be placed on my court case which Natwest have taken us to court for.
In short they are claiming £4700, which is made up of bank charges and interest which we have counterclaimed for.

I have had 6 accounts with Halifax/HBOS and have submitted claims last year which are on hold due to the test case. When the my claims were put on hold I asked for them to be settled under the hardship rules, my case went to panel and I was told that we weren't suffering financial hardship so my claim wouldnt be dealt with. I have received a letter now asking if we would like to be reconsidered as a hardship case, should I do this or wait to see what happens?
Any advice greatfully received.0 -
Certainly worth following through to see if they will treat you as a hardship case and if you aren't happy with their response you can ask the FO to look at your case.

The case management conference that will decide the next stage of the test case, originally scheduled for one day -next Thursday - will now be heard over 2 days and take in the Friday.
This may indicate that there are more issues due to be dealt with than was envisaged.0 -
I have just come off the phone to the Halifax. They were going to charge me £35 unpaid d/d fee. I told the man on the phone I was sick of paying bank charges and asked him how they could justify the £35. He said they couldn't and has cancelled the charge. I couldn't beleive it was so easy. May be it will be good news next week0

I have an account which Defaulted with the Abbey National in 2002 - £2000 made up solely of Bank Charges!! Unbelievably, there are just pages and pages of charges.
I never paid the money to them, so they don't owe me the 2k - but I would like the Default removing.
Is this possible?0 -
Dear Martin,congratulations on such a fantastic website,this is exactly the kind of consumer advice the public deserve.
I have been following your instructions on claiming bank charges via your website and wondering if you could help me.I have a Natwest Advantage Gold account and have sent the initial sample letter and have today received statements for the past 6 years.
The covering letter states;
"with reference to your request concerning any 'manual intervention' to the administrative charges debited these charges have been processed in accordance with the terms and conditions of our current agreement with you as a result of the activity on your account.In the event that you breach the terns and conditions,we will take the appropriate action,contacting customers when appropriate,or handling customer enquiries regarding their account status......."
Firstly what does all of the above mean and secondly,I assume I will only be entitled to any charges when I have been overdrawn,so do I add all the 'overdrawn' charges for the last 6 years,multiply by 8% to get my final figure?

I just wondered something. I put a claim in on an acct with RBS last July for £1555 and just missed the deadline. I then received the on hold letter within 14 days due to the test case. If the charges are deemed unfair and the banks start to pay out would you be able to claim in my case the interest on the money sat there since last July? I originally claimed charges only. Thanks for any help.0
