op - you could try demanding a POPLA Code re-send, or email bpa's Steve Clark asking that he intervenes and prevails upon parkinglie to do so.
It worked for me - delayed/never rcvd PE post et al. My parking events, reasons for stopping, were similar to yours: PE/UnWelcome Break. dark, late poop meteo etc.
PE lie about signage all the time..
So often we tell people not to over think these things.
In your case, I feel a mild surfeit of So Whattery? has led you in the opposite direction, but let's see what can be achieved now.
I'm deliberately not putting steve c's email here: learn to hunt these things out yourself and use them - all in the newbies stickies:-)

I'm aware of somebody with the same problem, although they are based in England. So same situation, parked up from a safety point of view for a sleep, empty car park, didn't see any signs nor were aware of such a charge. As this thread has been shifted so far sideways by an unhelpful contribution I was hoping that I could get clarity on the following:
1) Is it worth contacting the Welcome break as I'm guessing there must be some sort of safe driver clause in their contract? Is there such a thing? Do they have any influence over ParkingEye and this invoice (see I have read the forum for newbies)
1b) is there any value (from future appeals perspective) in offering to pay a reduced amount; e.g., £20 for the parking charge and out of pocket expenses - they'd pay £20 just to avoid the back and forth of these appeals and the uncertainty... if so, is it best to send a cheque off for that money and if they cash it then they have accepted the payment, if not then the driver has lost nothing and it could be looked upon favorably by the court if it gets that far?
2) As the person is based in England is there less certainty of it being squashed as POPLA?
3) Is there certainty of winning a POPLA appeal (it looks like ParkingEye will just reject the appeal straight off, so I'm assuming it'll end up with POPLA
4) If it does go to POPLA, and is lost, will the driver be able to pay the discounted charge?
5) It seems like mintosan chose to ignore/ throw away some of the letters, is that why what he is facing now is a probability that he'll have to pay the £100? Do ParkingEye actually take people to small claims and how is it received by the judge in general?
6) Does this type of case regularly win on appeal? Realistically if it's 50/50 then they will need to think about whether they can be bothered with the loss of time that they could be spending with their children

Reading your thread I saw the posts by the deep and then looked at part of his thread. in post #9 he boasts about how he has "successfully seen of two pcns from UKCPS and Town and City". What a hypocrite and then he moans about his parking problem caused by having properties with inadequate parking space!0

Thanks for the replies, I dont want to go to court, well it wouldnt be me would it? It would be a keeper.. However neither of us want that.
Im not sure what to do, I work full time all the time, been in 12 hours each day this weekend and was called out on an emergency all sat night until like midnight, I havent usually got alot of time to sit and read thread after thread to try and find a solution to this corrupt system. (However oddly enough.. i do right now, so im away to look)
Hence why I made a thread for assistance. Thanks to everyone so far who has posted here.
I need to wrap this up though, Id never get a day off work to go to court lol, heck I had days holidays and they were cancelled due to staff levels.
So maybe i'll just pay them or something cause i feel bad for my old man, as hes worrying like mad now. I hate this country more and more every day..0 -
I shall however go and find out about the above mentioned man. If I tell them who the driver was and get a popla code, my old man is scot free and Its between me and them? Cause if so.. Then letters coming to me doesn't bother me in the slightest.0

Hello all. I just wanted to let everyone know that this matter has almost been cleared up now.
I made contact with Steve and he got back to me this morning saying he has spoken to them, and as a gesture of good will I only have to pay £11 and the matter will be over with.
I have no issue paying for that as If I had seen the signs or machines, I would of probably paid anyway.. Or gone else where I dunno but anyway £11 to finish this all up with is a small price to pay imo. I did use the car park to sleep there was no question, so to pay for my time only seems the fair way to do so.
Now, if Parking EYE had sent me a letter originally, saying, "Look you owe us £11 for over staying in a car park you didnt pay for." Id of said, oh sorry here you go. However because they threaten you, and say pay this OR ELSE pay more now.. It gets peoples backs up.
Parking Eye if your reading this, food for thought you corrupt bunch of dodgers.
Thank you to everyone on here for helping me out over the last few months. I'll stick about and do some learning though, no point in wasting some good resources.
(Also I took above advice and went through all the noobs stuffAce.)
