  • IM BAAAAACK!!!

    Yes thats right, good ol PE have sent out more letters. An appeal was made and was followed up with a rejection letter, explaining it was 'a generic response' and that 'we've heard it all before.' So pay up now!

    I ignored it. Now another letter in today, threatening with court and additional charges etc etc..
    Im yet to see this second one myself yet.. In work but i'll check later and get it up on here word for word if its needed.

    Looking for someone to advise me on what to do next really..

  • Iv just learned about Parking Cowboys and the appeal company being run by members on here and it seems pretty interesting.. Possibly a good shout for someone like me who hasn't got heaps of time...?

    Did they offer you a POPLA code in the intial rejection letter? It'd be a 10-digit code hidden away somewhere.

    If there's no mention of it you can email the BPA telling then Parking Eye never offered you the independent adjudication and ask them to intervene, then fill in a POPLA appeal based on templates here and get it cancelled at that point.

    If they did and you didn't take advantage of that you've got a bit of a harder job. I'd still ignore anything that doesn't come from an actual court (phone the court to confirm) and defend it there, hopefully PE will drop it before court.

    I'm not sure if the parking appeals companies can do a great deal at this stage except help you with the court stuff, but it's worth dropping them a line.

    Afternoon all, I dont think the previous letter exists anymore.

    This letter I currently have from them states:

    "ParkingEye recently rejected your appeal in relation to Parking Charge Notice (please see above reference*), which concerned a breach of the terms and conditions on the XX/XX/XX at Welcome Break Keele, this charge is therefore levied for breach of contract. At this stage you were given the opportunity to further appeal this Parking Charge through POPLA - the independent appeals service for parking on private land - within 28 days.

    The 28 days have now passed and you have not appealed to POPLA or paid the Parking Charge in full. As such, we must inform you that unless payment of £100.00 is made withtin the next 14 days, further action will be taken and this is likely to lead to court proceedings, which will incur further costs. These costs will include, but are not limited to £50.00 solicitor's costs and £25.00 court claim issue fee. Should you wish to contact ParkingEye (details above and below), you must do so within 14 days of the date of this letter before claim.

    ParkingEye Legal Department.



    So... Is that it then? :/ cough up or else.. If I pay that company can they at all help me? Or what should I do, If I contact POPLA now will they just ignore me?

    There is a reference number which is 6 digits, then a slash and a further 6 digits, is that the POPLA number? The post is a bit rubbish here tbh.. this letter is dated the 3rd and I just got it today.

    Seems like you missed the chance to appeal to POPLA. They are most likely going to threaten to take court action against you now. Sit tight.

    POPLA should be a 10 digit code I think, there's a checker site linked in the newbies thread. Assume it's valid then you're stuck unless you can convince the BPA that they hid it from you, so you were unaware you could appeal.

    Email the ticket company and see what they say.

    Your choices are then: pay up, or let them take you to court. It's small claims, so not particuarly intimidating, and you can try to get it stayed until the Beavis case or taken to POPLA for adjudication, or even just get it put down at court, though it does mean a day off work.

    Of course, they may not bother, and you can always pay it off at the LBCC stage for what they are asking for now, if you really don't want to do court.

    We'd always advice court; even if you lose (unlikely if you're prepared), it costs them far more than they make. It's purely a heads-on-spikes exercise to scare people into just paying.
