  • so what do i do now, the bank - natwest - have sent me a letter saying that they cant deal with my request for excessive bank charges until oft proceedings have ended.

    I recieved the letter stating that all claims we being put on hold, the day after i recieved an offer letter from barclays, for the full amount including interest. I wasnt sure what to do, do i photocopied it and returned it anyway.

    My account was credited with the full amount within 8 days of posting it. This was only last week. I think i must have been right on the border of them paying out!

    what date did you recieve the letter was it after the oft announced test case

    my letter arrived on the 26th july, this was the offer of the settlement. i think the letter about the test case came the day before that.

    Myself and sister are both pursuing bank charges from HSBC. We have both agreed to settlement out of court, duly signed the acceptance and returned to them expecting the money to be re-credited to our accounts within the 14 days stated.

    The 14 days have expired now and HSBC have now sent a new letter (with the same settlement offer) stating that they cannot accept the previous signed and accepted form they have received they have to send this new one to tell us about the OFT test case and get us to sign a new acceptance. The offer is exactly the same amount on the exact same form!

    To cut a long story short about the lies being told to us about the FSA making them do it and telling me I didn't need to sign this new form but send it just in case! etc...

    My sister had her hearing to today and whilst he stayed all other claims the judge ruled in her case that HSBC could not ask their customers to re-sign an acceptance form and thought the letter was just a delaying tactic. HSBC should count the 14 days from when the original acceptance was signed or they were in breech of contractural law. As a point, although it was not my case he was hearing advised me to summons HSBC with my own claim for non-payment.

    I have spoken to HSBC this evening and told them I want my money by COP tomorrow or I'll go to the press and summons them but I thought I'd let all you HSBC customers in the same boat don't be taken in by this latest letter if you've signed an orginal settlement acceptance you do not have to sign anymore.

    I'll update tomorrow the outcome. Hope this helps some of you out there!


    Due to a computer problem I have just seen this and glad to see ajudge agreeing with my assessment. I have seen anumber of posts where banks have said to sign a new acceptance letter. For the very reason given by the judge I have always said that you should write to the bank giving them 14 days to pay or you will sue them on the agreement. Once you have agreed to the offer the bank cannot change the conditions and ask you to agree to different terms.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    I think you will find that the ombudsman will not deal with your claim until after the OFT case is finally concluded
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    Well I've rung them and rung them and they are still flatly refusing to give me my money until I have re-sent the blinking form! I have spoke to the FSA who stated they have not instructed banks to do this and they have only agreed to give most banks a waiver on how long they can deal with the complaints. So as I informed them I now want to go to the press about it so can anyone recommend anyone in the press who'd like to take up the story please?:mad:

    Not sure about the press but if you write them a letter saying that if you do not recieve the money within 7 days you will issue proceedings. If they then do not pay issue proceedings adding the interest on top. Please note the proceedings is for money due on an agreement.

    l successfully reclaimed charges against alliance and leicester for 1 a/c and received the offer the day of the test case announcement, at that point l was also waiting for the details of bank charges for another alliance and leicester a/c and now wish to claim for these, as the court charges will be over £100 l am reluctant to have them tied up till after the test case if possible, can you still lodge a claim with the F.O.S. ? a number of my claims are around 5-6 yrs ago so need to have the date of claim registered now but a bit confused what the best way to do so is .....thanks for any help..
