  • No i have not heard of any stays being overturned and when i went to my local court the chap all but admitted mine would not be either. I really feel that more needs to be done, but when need some worthwile people to kick start something

    HI Jester And Jonesy in particular, about Cardiff and anyone else involved in 14th August, 'blanket stay' You say you read about 12 of you being stayed,do you know there were between 500 -600 of us ALL set for the same time 10.30 on that day, all transfered a second time from our local court, obviously a set up, I smell a RAT, according to a case (Refer to the following)Claim Number: 7QZ63543

    The Bank representative asked for a stay in all three cases. The Judge asked if the Bank had submitted applications for stays into the Court he said they had The Judge replied' Actually no you haven't at all!' The Judge went on to say he did not think much AT ALL of the Banks asking for blanket Stays - when they do not actually apply for them the correct way ( individually and with a £65 cheque attached).

    Hickinbottom has not behaved in the fair way that many other Judges have throughout the country, I believe Wales is the only place this has happened Many of us went down there, but not enough to do any justice, but we handed in objections etc. We have all written the letters to the MOR, our MP's Rhodri Morgan, and anyone else the Western Mail, the South Wales Echo, the banks are being helped by the court here and it shouldn't be allowed!

    MARTIN IF YOU ARE OUT THERE READING WHY CAN'T WE DO SOMETHING ABOUT THIS THEY ARE TREATING US SO BADLY AS IF WE DON'T EXIST ANYMORE. THE COURT , THE FSA AND THE OFT ARE ALL WORKING FOR THE BANKS.

  • Okay, So I wrote to the bank (Natwest) reclaiming my charges at the end of june - I got a response from them saying they would deal with it in 6-7 weeks! I wrote back saying that they were requested to deal with the complaint within 14 days, didn't hear anything back until I received a letter a couple of weeks ago about all claims being suspended because of the OFT thing.

    Is it likely that they put me off knowing that it would commence and they wouldn't have to do anything or is that their standard response?

    And what do I do now? I don't want to wait so long to get my money.

  • I still haven't got my statements so not sure how much i'm entitled to but they did send me an offer of £470 when i asked for my statements, when they wrote to me about the test case they are still offering me that sum.I really don't know what to do as i really don't know what way this is going to go.Also i think i can claim on my credit card but not sure as i have been paying for the last year and the balance is more that the start, any ideas please.

    I put a claim in to barclays a few months ago and they held their line that the charges were fair etc. I followed the process that Martin has layed out and submitted court papers 2 days before the OFT announcement (my usual good timing!).

    Barclays have acknowledged this and I believe this means they are going to file a defence :(

    Does the OFT case mean my court ruling will be held until their case is decided or will it be upheld regardless? Anyone else in the same boat?

    Barclays have also offered me a settlement of around 60% of what I'm asking for, since I submitted papers to the court, will this still stand after my case has been decided?

    I'd be grateful for some advice.....
  • I've been to court today, and was met by the lawyer from Barclays who asked if i knew about the stay? I told her i did but that it was not being upheld in all the cases, but her attitude was that it was a foregone conclusion that she would get it, and guess what, she was right. From the minute i walked into the room and met the Judge, it was obvious that i had just wasted losing a days wages to go to Court. I am SO depressed and don't know where to go from here? Also just a quick note to Conor. You don't know everyones individual situation, some of us really did try hard to keep financially viable.

    I finally received my statements from Clydesdale yesterday requested on 21rst March (they stalled and stalled, ignored ICO all of which seems to have paid off).
    What I would like to know is if anyone knows whats going on with the Scottish courts, I'm in Perth, so if anyone has any experience of this please let me know.

    I really feel for you. I was given judgement against HSBC and they are now appealing to the court to have the decision over turned and the case stayed until after the test case. I still have a little faith left in the court system, and so hopefully they'll take into consideration my arguement against over turning the judgement.

    The way I feel at the moment is, you get a small victory and then they snatch it away from you. The banks are clearly throwing a load of money at preventing any pay outs from now on.
