I originally asked for my statements (2 accounts) in February, at the same time my son asked for his..and so did many other people, I had told about reclaiming bank charges..
Son and everybody else all sorted, money paid back.
Eventually found out Barclays claimed they sent my statements out, I didn't receive them, so they sent them 'again' THREE times.. !! (waste of paper and money, don't you think?!?!?)
Anyway to cut a long story short, I have been offered £200 on one account (£75 less than I asked for, so not too bad), but got a letter saying all cases on hold... so the other claim (approx £700) not getting paid out, at the moment.
I am soooooo fed up, I'm relying heavily on that money, I have since been charged another £180 since July, and I know I will be charged again and again before my wage goes in, providing my DD's get paid!
I feel sick, I've just got over depression and thought this was going to sort me out (clear my debts) but it's just getting worse to the point where I feel whats the point ?!?!?!?!!?!?!?!?
I'm desperately looking for a part-time job alongside my full-time job, but at the moment I can't see a way forward...
I haven't yet accepted the £200, I was hoping they would sort the other account out too, but I guess not.
How can they make a decision on one and not the other, when both were submitted at the same time?!?!
I asked why they hadn't sorted it from when I first applied in February, to be told they had to sort it from when they recieved my letter detailing the amount claiming.. which I sent on the 29th May !
Please, please can someone help me out here...!!
Thanks for reading x0 -

What stage are you currently at? Have you filed at court for either of the claims?
Banks probably won't investigate further into any claims. I'm not sure why they would offer payment on one claim but not the other. Maybe you can ask them.
It's still advisable to continue and file your court claim after the time has expired for the bank determined by your letters. This way when the test case has been heard, you will hopefully be in a position to quickly get your money should the outcome be positive.0 -

Hi nickmack
I haven't filed any court claims, I'm not confident about doing it, as I really can't afford any costs.
I did ask them why they had only acted on one claim, (before I received the letter about all cases on hold), they said they were dealing with the other case, then the letter arrives.. 'all cases on hold for at least 12 months'!
I'm sorry to sound a bit 'dim' but I need things to be put in laymans terms as I'm confused about what to do. I have a lot of other things on my mind, sorting out my bank charges is first on my list.
Thanks again nickmack0 -

Most banks are using the waiver to stop investigating customers 'complaints' about charges. They should however continue if the customer can show 'financial hardship'. Unfortunately, this is not clear, you would need to provide evidence if this is the case. The problem with this route is, the bank may then make an unacceptable offer, after which, you may need to go to court anyway.
It may be better to try to persuade the Financial Ombudsman to take on your case citing Financial Hardship.0 -
I was wondering if anyone was in the same position as me? I just successfully claimed from RBS for our joint acct. A couple of days after sending the letter for this account (on which offer was received day before test case ruling) I sent another one claiming for my sole account. It was put it in the internal mail bag with my RBS branch on the 23/05/07.
Now my point is, allowing a couple of days for it to get to the correct department the 8 week date falls on the 18/07/2007. Which means I should have had some contact with regard to an outcome by this date.
However due to the fact the case was logged on the 13/06/07 it meant the 8 week date fell after the test case ruling date which I feel is not my fault. Surely if the bank logs a complaint 2 weeks after receiving a letter that is not the fault of the customer?? Any advice would be gratefully received

According to this the test case will begin on 14/1/2008, so it hasn't actually started yet?

Can We Not Start A Petition Which Could Be Delivered To Downing Street Stating That The Courts Should Not Make A Stay Against All These Applications And Why. Surely If Like Everything Else Enough People Shout Loudly They Get Heard. If Martin Lewis Were To Suggest It Then I Am Sure Everyone Would Get Involved. Please Someone In The Know Advise If This Is Possible0

Has anyone heard of any Stays being successfully overturned?0
