  • Hi Every1,

    i have been told by the courts my date is set for Nov 2nd, i need to send a court bundle to LTSB and to the court, and to also have a copy for myself.

    One problem... what is the Court Bundle???

    I have searched the site, and every link i come across does not work.

    I am worried about this and dont want to go to court, but as LTSB have done nothing but defend, and not hearing from their solicitors, i think thats where am going.

    the only thing i have every recieved from the bank is the standard letters every1 else has recieved at the start of the claim. i am certain i have done this wrong somehow... i had no goodwill gesture, nothing from solicitors.... i feel invisiable!

    They still taking money out of the account which i am no longer using... havent done since may.. its all very strange.

    can some one please Please help with what i need to do.

    Court Bundle check list link is now working again, sorry about that. As the Court Bundle is pretty lengthy I wouldn't go printing it out until much nearer the time as November is quite some time away.

    There are time limits set for dealing with these issues.
    Like the 40 days to return the bank statements, the banks had a maximum of 8 weeks with which to process all claims.
    Taking longer is an "abuse of process" and therefore the fsa agree that the fos should be tasked to take action.

    I have two claims that have been transferred to my local county court, one is with citicards and the other with halifax, should I just continue the claim?

    I think i have made a terrible mistake, in fact i know i have...

    i was gettin everything ready... statements of chgs etc.. an i have discovered my calculations are wrong!!! ONLY BY £600 ODD!!! omg what do i do??? am on court date stage...

    was checking everythin was right, an was looking at things i can claim for, i am almost sure i have claimed for overdraft interest too...

    omg am such a DOH! please help... wot should i do? ring the bank. court??:mad:
    cant believe it... i really cant. am, soooo stoopid!

    may I ask when you filed your claim as this is relevent to doing an amendment, you have 4 months from issue date to file an amendment, you may still be able to file an amendment but you better do it quick and when you do it you will need to attach a new schedule of charges, this must be done in red you will also have to change the amounts on your claim form by crossing out existing amounts with a red line through them then you will need to fill out a N244 form with the reason to the amendment.
  • Myself and sister are both pursuing bank charges from HSBC. We have both agreed to settlement out of court, duly signed the acceptance and returned to them expecting the money to be re-credited to our accounts within the 14 days stated.

    The 14 days have expired now and HSBC have now sent a new letter (with the same settlement offer) stating that they cannot accept the previous signed and accepted form they have received they have to send this new one to tell us about the OFT test case and get us to sign a new acceptance. The offer is exactly the same amount on the exact same form!

    To cut a long story short about the lies being told to us about the FSA making them do it and telling me I didn't need to sign this new form but send it just in case! etc...

    My sister had her hearing to today and whilst he stayed all other claims the judge ruled in her case that HSBC could not ask their customers to re-sign an acceptance form and thought the letter was just a delaying tactic. HSBC should count the 14 days from when the original acceptance was signed or they were in breech of contractural law. As a point, although it was not my case he was hearing advised me to summons HSBC with my own claim for non-payment.

    I have spoken to HSBC this evening and told them I want my money by COP tomorrow or I'll go to the press and summons them but I thought I'd let all you HSBC customers in the same boat don't be taken in by this latest letter if you've signed an orginal settlement acceptance you do not have to sign anymore.

    I'll update tomorrow the outcome. Hope this helps some of you out there!

    Can I just ask if anyone is aware of the position with regard to the hearings in the Cardiff County Court this Tuesday14th August? 500+ of us had our claims stayed in a huge 'blanket stay 'ordered by judge Hickinbottom. We were only informed on Friday 10th some a few days earlier! but we are under the impression that this was definately against the ruling of the MOR ( Master of the Rolls) and we have all sent in objection letters to the MOR, MPs Banks And CCC. using the templates put together by some very clever bods have alook on the CAG Cardiff Directions Hearings site.
  • Just a quick post to confirm that I received a Holding Defence through from Yorkshire Bank this morning. They confirmed that Money Claim Online are staying all claims pending the outcome of the test case.
