Just recieved a letter from the court about my case, saying my case, along with several others wil be heard on September 18th at Central London County Court....anyone else got one of these? attached to it is an order dated 26th July saying:
1) There will be a preliminary hearing in this case (and in several others which raise the same or simmilar issues and involve the same defandant) at a time and date to be notified to you with this order
2) The hearing is intended to give directiions for the hearing of some or all of these cases in a way which saves time and expense.
it goes on, but those seem to be the main points, of course at the bottom it does say the the defendant may apply for a stay, hoping this will not happen as it seems that the court is putting my case, along with others, forward as part of the test case? or am I just being over hopeful?0 -
Arism - the same has happened to me, I got a letter from the court today which was a judgement order, but instead of saying I was awarded my claim, it said that the claim is now pending for test case at high court! I thought this did not apply to credit card claiming???
I phoned them and they said to write to them saying that it does not apply but don't they already know this?
Who do I write to at the court and what do I put in the letter, I am getting tired of this now, been dragging on for months!0 -
yOU ARE REQUIRED TO COMPLETE A FORM N244 TO HAVE THE DECISION SET ASIDE AND YOU MUST STATE YOUR REASONS WHY, THE MAIN ONE BEING THAT LARGE INSTITUTIONS CAN WAIT ONE - TWO YEARS YET IT WILL CAUSE FINANCIAL HARDSHIP TO AN INDIVIDUAL ETC TO HAVE TO WAIT THAT LONG. I WOULD ALSO PERSONALISE THE LETTER BY SAYING THAT EACH CASE IS INDIVIDUAL AND THAT YOU HAVE OTHER COMPLAINTS WHICH YOU DO NOT BELIEVE WILL BE HANDLED IN A TEST CASE0

Hi Every1,
i have been told by the courts my date is set for Nov 2nd, i need to send a court bundle to LTSB and to the court, and to also have a copy for myself.
One problem... what is the Court Bundle???
I have searched the site, and every link i come across does not work.
I am worried about this and dont want to go to court, but as LTSB have done nothing but defend, and not hearing from their solicitors, i think thats where am going.
the only thing i have every recieved from the bank is the standard letters every1 else has recieved at the start of the claim. i am certain i have done this wrong somehow... i had no goodwill gesture, nothing from solicitors.... i feel invisiable!
They still taking money out of the account which i am no longer using... havent done since may.. its all very strange.
can some one please Please help with what i need to do.

You are required to send a copy of everything you intend to use in court, ie, all letters sent from you and received by you, copies of all statements showing charges, copies of any articles you have got showing charges unlawfull etc. Also any personal letters you have written to the bank, ie complaints etc. you must do a full copy of all of this one for you, one for the court and one for the other side. When you send the paperwork in, keep a certificate of posting for the cout and the other side. This is got from a post office and is free. Good luck0

I wrote to my bank to reclaim my bank charges over 2 months ago, they made me an offer 24 May 2007, I handed the acceptance form into my local branch on the 30 May. Which was then apparently lost... I have been chasing up getting another acceptance form since then, will the test case effect my situation? Any advice gratefully recieved! I apologise if this has already been covered (this is my first post!)

I requested the copy of my backdated charges ages ago for 3 different accounts with the Natwest. Apparently they changed system about 4 1/2 years ago so the oldest 18 months were to be sent seperately - after 4 phonecalls each punctuated with waits of up to two to three weeks (as each staff member said it took that long) I finally received a bundle - a second copy of the most recent 4 1/2 years!!. Eventually got the ones I did need on the day the announcement was made - tends to make me think there must be more to it.
Needless to say I had not started any proceedings until I had them all - am I now too late to go for it? Probably looking at around £1000-£1200 which could be extremely useful0 -
I got all my £320 charges back from the Nationwide in full, no arguments. The Banking Ombudsmen got them back for me. I went through the whole writing letters and they got it all back to me within 6 weeks.0

You must start your claim in the normal way following Martin's step by step guide in his article. More than likely the bank will come back and say they won't be doing anything until after the test case is over but if you have charges going back six years you must follow up the LBA and start a court action or your initial charges from six years ago will be time barred.
