I received a settlement letter on the 27/07 for the full amount of my bank charges i have been trying to claim (£490) i accepted and sent it back.
i then received on the 06/08 a letter saying my bank is still willing to pay my settlement fee and i must contact them with in 2 months of it will expire.
however i have had an extra £140.71 of charges on my account since this first claim and im not sure what to do? Should i take the £490 or wait until the test case has finished and try to claim the extra £140.71 (£630.71 total) baring in mind if the case is in favor of the banks i might get nothing
any advice much appreciated

make sure anything you sign doesnt preclude future claims. unless the case goes on for 6 years you should still be able to claim the new charges after the test case. £490 now is better than a poke in the eye with a sharp stick :-).claimed/settled - Natwest £2,535/£2,535, HSBC visa £80/£80, MBNA £1,258/£1,258, capital one £282/£282, tesco visa £515/£515, HSBC visa £140/£140. HSBC £1,450 MCOL Stayed for OFT case. Chelsea Mortgage charges & cashback £5000/£672. complaints with banks pending OFT Halifax £30, A&L £35. TOTALS £11,325/£54820 -
Be prepared!My hearing against HSBC is to go ahead! They owe me £1700 in bank charges.
I called the court this morning (Clerkenwell & Shoreditch) and was told the hearing is still on. Im assuming its because i had the court date before the 27th announcement.
Guess HSBC will try to stall it - hopefully they will just pay up!!!:j
My case is on the 14th and was told last week it was definately going ahead.
I recieved a letter yesterday from SCAM to say they have put in a stay. And yes the court has just informed me they have agreed the stay.
i dont understand how they are allowed to get away with this. 2 working days before the case. How on Gods earth am i to get a defence in to uplift the stay by then. I am a normal middle class person who has to work 6 days a week to make ends meet and keep Lloyds TSB in profit. Not a high class Barrister who could just whip up a fab defence in maybe 30mins. To say im angry would be an understaement.0 -
just keep going nothing else we can do. im in the same boat. gonna keep paddling tho. hope it all works out or the magna carta was a waste of time.

apply to the court to have the stay set aside there are good points in the defence on action stayed thread..go read it...it is quite beneficial and i think it should be sticky,dBe prepared!

Make sure you report them to FSA, for when they review the waiver.
They have messed you about, and its not on.

Since the OFT announcement they are getting away with staying all the claims. So until the outcome they're just going to take the P**s out of us.
and they are allowed to get away with it. i would call them more than what you did im afraid. We are just totally powerless!!0
