    Barclays are already abusing the FSA waiver.

    They are claiming that credit cards are covered, and they are ignoring the hardship rule.

    The waiver should be scrapped.

  • please can someone help, i'm off to court tomorrow and southampton court say its still going ahead, what do i need to take with me or will it be a case of the bank asking for a stay until the final decision/test case is made?

    Hi Martin,

    Other forum members have reported that Barclays, and other card companies, are using the test case as an excuse not to respond to credit card claims. They are even telling the courts, that the test case will include credit cards. The FOS confirmed to me yesterday, that credit cards are unaffected.

    I personally wrote to Barclays, asking them for a case to be looked at under the hardship rule, and they replied saying that they will look at it after the test case.

    I will be writing to the FSA , OFT and FOS about this.

    A big thank you for all you have done for consumers over the last few years. You can see from my signature, that i have had much success, all thanks to you and the forum members.

    Add this to the money saved from insurance, gas, electric etc, and i may be able to get out of debt one day, something that would not have been possible without you.

    I sent my application to have the Stay removed on Monday by recorded delivery and know that it was delivered yesterday. Hopefully, I may hear anytime from today onward whether my application was successful.

    Ironically, as a Swansea resident, it woul have been closer to have had my hearing in Llanelli rather than Cardiff, but the Swansea County Court switched mine to Cardiff a while back. Cardiff CC 45 miles away from me, Llanelli CC 13 miles away from me. Hmm, do ya think someone is trying to put me off ? lol

    I received a letter from SCAM today stating that they have written to Llanelli court today asking for a stay, and that i am to write to them and the court whether or not i am in agreement with them.
    I tried to ring the court but i didnt get in from work till 5.30 so it was too late. the letter i received has really annoyed me because it is all one sided, and sounds as if the stay has already be granted. One thing i did pick up on was the fact that, they state in the letter that Lloyds TSB has asked the FOS not to proceed with any complaint they are handling until the outcome of the OFT. Could i use this in my defence as this is my own personnal claim against Lloyds and has nothing to do with the FSO. Are my wrong? i am not familier with the court system so might be barking up the wrong tree.

    Sorry the number i called was 01264 725214. But i have since found out it was a load of rubbish i rung them back and they said i had a wrong number and they wouldnt deal with claim. Even when i asked for an out of court settlement they said that id have to write in to them and by the time they had opened the letter it would be after the court case. I have today had a letter from SCAM informing me that they have applied for a stay. Keep you updated

    any one got an answer for this toughie then:confused:
    i aplied for my statements etc had then put in a claim for £2,000 which is going through the system but also on the same claim mentioned within a month nat west had sent me out another set of statements thati found had an extra two years worth of charges that i hadnt claimed for so i sent these off in a sepatate claim (although it was for the same account) for £1300 the first part of the claim is now on hold but funny enough the second part for 1300 i have been paid out for what do you think i shouls do as i am meant to be in court next week not sure of i should phone and explain, as they have admitted fault on one part of the account.........tricky one???? thanks all for your time and help in all this x:confused::confused:
  • My hearing against HSBC is to go ahead! They owe me £1700 in bank charges.
    I called the court this morning (Clerkenwell & Shoreditch) and was told the hearing is still on. Im assuming its because i had the court date before the 27th announcement.
    Guess HSBC will try to stall it - hopefully they will just pay up!!!:j
