I think Credit cards will be unaffected as they have already had an OFT ruling of £12 deemed as reasonable.

£12 was just a level above which they wouldnt get involved. i have several credit cards and one bank and one mortgage company still awaiting statements. most of the charges on these are 5 years old.
Given the 6 year limitation, i still intend starting court action. probably only give the banks 7 days to respond as i am aware they will not respond on FSA authority. i fear if court isnt started the banks will save a fortune even if they loose in however many years they drag this case and apeals etc out.
charging for transactions great if you make a transaction pay why hit those who are porest to allow saving for those that are richest.
i feel its a done deal tho and banks will be allowed to say £20 is fair and we all looseclaimed/settled - Natwest £2,535/£2,535, HSBC visa £80/£80, MBNA £1,258/£1,258, capital one £282/£282, tesco visa £515/£515, HSBC visa £140/£140. HSBC £1,450 MCOL Stayed for OFT case. Chelsea Mortgage charges & cashback £5000/£672. complaints with banks pending OFT Halifax £30, A&L £35. TOTALS £11,325/£54820 -
I have just got off the phone from the Money Claim Online (MCOL) customer help line (Tel : 0845-601 5935). I asked how the High Court case will affect my court procedings as I have served papers against Lloyds TSB and am now waiting the mandatory 14 day reply period. I was informed that it is "Business as normal" and until they have been informed to suspend cases they will continue to process and hear those in the system.

bare in mind that that your under no obligation to complain to your bank, and if the courts will still accept individual cases, then you have the option of procceeding directly to court.
it wouldnt supprise me at all if the banks tried to take advantage of this panic, and tried lowballing everyone with crapy offers.0 -
I smell a stich up. If consumers are stopped from making claims why haven't charges been suspended as well? Any chance of getting an injunction to make the banks suspend charges I wonder?0

It now seems evident why the likes of Abbey in particular have obfuscated with their 4 week and further 4 week letters.
This smells of a conspiracy to me.
Well I got my daughter £210 (gestures of goodwill) out of £590 from Abbey and was about to go to the FOS for the remaining £380 plus interest.
I guess we can kiss that goodbye now.
A thought that occurs to me: When the banks win the charade sorry court case will they be able to sue for all the monies they have paid out already?0 -

I have just read all the press releases from the FSA, OFT AND Financial Ombudsmun and unfortunately for everyone going through the reclaiming stages it is all on hold. I have just phoned the FSA and my bank The Abbey, one of the banks involved in the test case, and been told that even though my claim is 3 working days away from the FSA 8 week complaint ruling mine is now on hold until further notice, how pig sick am I. Keep up the good work for all consumers and good luck to all still going through the reclaiming stages.
P.S Just checked online banking and the Abbey have just credited my account with £790 today, although original claim was for £2210, now have to decide to accept full and final or without prejudice.:eek:0 -

I suspect not. I suspect they will be hoist on their own petard. After all, the payments made so far are "goodwill gesture"s, not payments that were due under law. They were also made "without prejudice" which means they cannot be seen to set a precedent under law. As such (though i'm not a lawyer) I suspect that payments already made are outside of the justice system. - probably regarded as gifts.0 -

Yes morally they shouldn't have it both ways.
You know and I know that they will though!!
The banks have almost certainly behind the scenes threatened charges on credit current accounts, cash machines etc if nothing is done and no doubt also suggested that political donations will be made if a favourable result occurs!
The courts will be instructed to take as long as possible over the decision so that the media lose interest and the banks will then win.
My concern, as I said above, is will they be able to get money back that they've paid out when they do win?0
