  • Just got off the phone from southend on sea court, my case was due to be heard on 13th september, and a lady on the help desk has informed me that all cases have now been put back till end of december, were they will all be reviewed again. Everyone should have a letter within the next few weeks regarding this .

Does anyone have a estimate timeline that this court case is going to take?

I was coming up to the end of my 8 week wait after filing my complaint with HSBC and now what???

Are we talking days/ weeks/ months/ next year til a verdict is reached and we can carry on with our claims??

I have a directions hearing set for August 14th, i dont think i've got a chance of the judge hearing my case, i imagine he will use this as a reason to stay the case. If thats so then there is nothing i can do , just have to sit back and watch the interest pile up!

    Well done Martin :T

Same Date as mine Shelley and same location! I just called Cardiff court and they said that this hearing will still take place regardless...

    See you there!

The timescale I've been told is "likely to take more than a year".

Interesting point on ITV news. If you are in 'hardship', your bank must still handle your claim.

So if you are not working, i assume you can still go ahead.

But surely, if you are in debt, you are also in hardship. I would have thought many bank claiments have some hardship, or they would not keep going overdrawn in the first place.

I wonder what they class as hardship, i'm a single mum and was counting on that money for when i start Uni!

Most banks are quoting a year, but another member says they are trying to 'fast track' the case.

At the end of the day, all they have to decide is if the contracts regulations apply, so i don't know why it would take a year.

Then there are appeals, if granted.

But i would expect this to be sorted late this year/early next, due to the importance. Banks are well known for dragging their heals, but both sides have promised a 'quick' outcome.

Has there been any comment for the courts, regarding existing claims?

I know all of the banks are applying for stays in all cases, but what if the notice to apply for stay has expired. The courts are telling us to carry on regardless, the banks are saying all cases are suspended, what is the legality?

I think we need some clarification from the courts as to what is happening with the cases that are already in process.

Claims still proceed as normal if they're in the court system already, the banks can ignore it if they like but you'll still win! :D

    Hey everyone,

I just wanted to check something, the BOS received my acceptance letter more than 2 weeks ago and I still haven't had the money in my account. I just want to check that even with this new Test Case stuff that I will still get it? Judging from other comments I think I will but has anyone actually spoken to their bank or the FO?

    Thank you
    Caz

My sources from within Lloyds TSB say that they have set an official policy of honouring all offers, even if they haven't yet been accepted.

Hi all, if you go to the British Banking Association website (bba.org.uk) there is a posting which includes confirmation that the banks will honour all offers, whether accepted yet or not.
