    Hmmm should I reconsider the 70% offer from Barclays? I need the money but I hate them that much that I'd sooner risk all to get the lot back. I'm bad with money always have been but have never had any help from them they just stick the knife in further. Accepting their offers to me would be seen as a victory for them. Keep the faith and we may just win.

    Another question in regard to this... since this is a test case, with only 7 banks involved, does this mean business as usual for reclaiming bank charges with banks that are not part of this test case, i.e. Halifax?Surely they can't hide behide this test case, as they are not part of it??Thank for whoever has any info about this!Gerry

    not a question of being noble more a case of being angry. I do see your point but I really do feel strongly about what has gone on. These banks have settled with thousands of people and are obviously sick of paying out but why should I or anybody else be treated differently. I appreciate they admit no liability etc but to me the law is an !!!, how could any reasonable person not agree that if they are paying out to some of their customers they should bite the bullet and pay us all.

    Yeah, you are right... I just think that we've been slightly lucky/cheeky so far by claiming back the full amount. Banks do have the right to charge an admin cost, they've just been inflating that cost beyond its true reflection.

    So, assuming this is all sorted out and justice is done, we will only be able to reclaim the difference between the charges and the true cost.

    They have been screwing us over for years, but we have also been taking advantage of this situation in order to get cash (most of which we are rightly entitled to, but not all).

    I still want my money though!!!

    I think we need some clarification from the courts as to what is happening with the cases that are already in process.


    Maxinex - See my post on page 3 of the Thread unless and umtil the Lord Chief Justice issues a direction staying all existing claims they continue. The Banks will have to apply in relation to each case for a stay. It will cost then £65 for each application and that is just the issue fee.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    Well i'm completely jobless at the moment, but I don't intend to be jobless for the entire duration of a claims procedure. I'd be interested to hear more on this.

    Thanks for that, my application for a stay ran out on 24th July, so hopefully they won't be able to apply in my case, spoke to Bank about this and they say I might be one of the lucky ones, depends on the judge at county court, or if all the court system issues direction otherwise.

    i noticed a clause in the OFT document which stated that banks should investigate cases where the claimant is experiancing hardship, qouted below. My case could be deemed as extreme hardship would it be worth looking into, if so could someone help to draft a letter.
