    From what I've seen on this, if they have made an offer they will honour it and you should still be able to accept. Bear in mind, this is not an official answer - just my conjecture - but it would be highly unethical for them to withdraw an offer shortly after making it.

    I also know that banks are asking the Courts to suspend cases that are in the process... my date is next Friday! However, just because the banks ask for those cases to be suspended doesn't mean they will be. My feeling is that, with only 1 week to go in some cases (including mine), it could be too late to pull out.

    Personally, I'm going to wait until I hear something from the County Court before I change my stance - in the meantime, I'm still preparing to appear.

    If you look at the OFT and FSA websites you will see that all the banks/BSoc are the relevant banking GROUPS.
  • I am currently in the process with Abbey & Lloyds TSB.
    Abbey keep sending me letters claiming that "it is taking longer than ususal to process my complaint (sic)" - so i gave them the 14 days and want to send out a court form.

    Because of what happened yesterday is it worth doing or shall I wait until this fuss is all over?

    There are exceptions to the moratorium (ie financial hardship) when the banks STILL must investigate your complaint.

    THis case does not cover credit card charges; it's only testing unauthorised overdraft charges...

    I'm thick as well as being peed off.

    Whatever the outcome of the oft investigation (probably won't help us much) the fact is that the banks have repaid charges to thousands. How can the say the won't pay anybody elses or only pay them a little bit back?

    I just called the Fo as we had a claim going through. They told us that the file had been passed on to team 10. I was passed through to them and all they would say was that we would get a letter within the next 3 weeks. Not sure what that is supposed to mean!!!!! Anyone have any ideas?

    I also called the Natwest, who informed me point blankly - whilst reading monotimously off a card that as of the 27th July all complaints were on hold - they are loving it! I said yes- but I did not claim for overdraft arrangement fees - I have no overdraft on my account - it is a basic account. All my charges were for returned d/d. They said its all the same thing and thats the end of it. Not arguing with you - end of story!!!!!!!!!!!!!!!!!!
  • What I'd like to know, Martin, is whether this test case is, as per the OFT website, part of its investigation... Their statement says that if they found that the charges were unfair they would take the case to court. If this is the case it could be good news for us?!?!

    QUICK QUESTION: relates to many people and this recent OFT case.

    Many people have recently received funds into their bank accounts, whilst pursuing claims. After telephoning the banks concerned, and asking for higher amounts, the banks have not budged. Therefore, many people were going to go to the FOS/MCOL route to claim more.

    WHAT SHOULD we put in our statements back to the bank
    along
    the lines of ?

    "Accept the recently deposited amount as PART PAYMENT of full claim without prejudice, and will claim for the full amount once the outcome of the recent OFT test case has been decided."

    SUGGESTIONS PLEASE???
