    Does this mean credit card claims are unaffected?
    Also are claims against banks not included in this test case still vulnerable to us reclaiming from them??

    For any claims postponed til after this test will interest for the extended time still apply?

    will there be a freeze on bank charging and applying itnerest to charges already incurred?

    I cant help but feel a little sick at his news, the fact there has been nil consultation on this matter and knowledge that the OFT have been investigating charges for some time along with the very close relationship the banking industry has with the OFT all makes me feel as though we are about to be taken for an enormous ride, of say, £12 again!

    I just hope that i will be able to one day claim back my £1800 of charges from barclays. They allowed me to go over my limit when they could have prevented it. they profiteered from my going over my limit by charging me and also by adding interest (which is the real cost of loaning the money, not the default fee). Well, here's hoping... i dont even want to think about the banks winning.

    i don't know if anyone else has noticed but my last penalty charge was less than the previous 1 for the same 'offence'. my 2nd to last was £25 for going £6 overdrawn for 1 day. however, my last one was £16 for going £9 over.

    it's taken nearly 6mths, due to the 1st set of charges but we are finally seeing that we have more left and no charges incurred. as i started my case in february, i shudder to think what HSBC have taken off us since we went for the charge return

    A couple of points:
    1. I have been trying to get details of my account with the Abbey (closed in Oct. 2006), since February of this year. They have not complied with the 40 day rule (it's now around150 days), despite being reported to the Information Commissioner. This has "bought" them 5 months of my "claimable" 6years, and even more of this time will now be used up due to their complete disregard of the rulings on SAR 's. So when the Test Case has been settled, will we be able to backdate any calculations? Will the Banks be held accountable for their stalling tactics, if they amount to a disregard for rulings?

    2.The Banking Representative on the News item stated that going into unauthorised overdraft was avoidable by 'phoning the bank. That is not true, we tried (when my husband heard by text message that his employer had gone broke, and his wages had not been paid). I immediately phoned the Bank to ask for help, even by stopping or stalling the DDs , but they basically said "tough luck". Will there be new guidlines for helping those in difficulty, after all, most people have money problems thru' no fault of their own, yet they are the ones most heavily penalised?

    i was left with a 11 month old baby (through no fault of my own) and a part time job my wages were due to go into the bank 1 day after the DDs were due to go out so i phoned the bank and asked for it to be delayed i was also told "tough luck" and then charged £130 in 1 day how on earth with a low income are you supposed to recover from those charges so they only escalate !
    i have a bank hearing in august so i wonder if i will be the loser again
    i hope not

    My cases are all against Credit Cards, so I would also be insterested to know if this is just oveerdraft charges or will effect claims for credit card penalties.

  • sounds like we've been well and truly screwed by the OFT and FSA. I have a court date for September, I guess that is going to be kissed goodbye. The next thing is how to reclaim the court fee for a case that is no longer going to happen.

    These people are in the Banks pockets and its unlikely there will be any judgement on this subject for many months. The legal system in this country is not very rapid at the best of times.

    Oh well guess I will have to go back to working more overtime again

    Hi, I think loads of people have probably asked this question.... I have just recevied a court date after lots of hard slogging to get to this stage, I am now wondering if this date still stands??? :confused::confused:

    Obvioulsy this is going to take a long time to sort out, but does it mean the bank will have to justify why their charges are so high? Surely its a done deal already for those who say the charges are unfair..... The OFT has already ruled on the credit card companies (many of whom are high street banks), so surely the rules should apply to current accs too - exceeding ur overdraft is basicaly the same as exceeding ur credit card limit :confused:

    And hopefully someone will ask the question of which consumer group they discussed this with!

    Will be interested to see the outcome
