Hmmm should I reconsider the 70% offer from Barclays? I need the money but I hate them that much that I'd sooner risk all to get the lot back. I'm bad with money always have been but have never had any help from them they just stick the knife in further. Accepting their offers to me would be seen as a victory for them. Hi Martin, Good job with our defence, she did not have a clue on what to say. I do have a question i have a claim going through MCOL against Natwest, they never acknowledged a defence within the 14 days so i pressed for a judgement to be issued, when i went online to the MCOL it said that my claim for a judgement to be issued was accepted and was issued on the 26th July 07, does this affect my claim as i am so near to issuing a warrent. They owe me with interest just over £5k.0

Can't believe the timing.
I have the following going on :
Letter received yesterday morning from my local Court, Small Claims Court hearing against Abbey National set for August 28th (£6,000). - is it worth preparing the Court bundle/will it be stayed????
Letter received Thursday morning from NatWest offering me £654 against a claim of £3,900. Was going to do a letter this weekend accepting as part payment other wise going to do MCOL. - Can I word a letter getting the £654 knowing they will mess about after that and is it worth paying MCOL the £250 thereafter (as with interest the claim will be nearer £5,900).
Claiming against Natonwide for £1,300, and their LBA ran out this week and was going to go on MCOL this weekend to start this claim. Again is it worth it ?
Any help appreciated.

If you read the OFT AND FSA statements on their websites, people will see that 1) it is up to the courts to decide on an individual basis whether to proceed with claims. This means you could take a bank to court still. or the court may decide to wait until the outcome of this test action.
2) the fsa/fos will not be investigating complaints re unfair bank charges until out come of test case is resolved.
This does not neccessarily mean people should stop claiming through court process. But it may mean once you file your particulars of claim that nothing much else happens for now.
Also, this does not affect credit cards claims as the action specifies bank charges and overdraft fee's and the OFT have already done a report on c/cards
. This does not affect SAR's requests as has been noted this falls under data protection laws. Also, if the bank you want to claim against is not one of the group involved in this action you can still claim. However, again the courts may potentially decide to postpone doing much until this test is resolved.
Just trying to condense the situation into a brief summary. I would suggest if you cant afford to take the chance on paying the mcol fee, then hang fire for now.Sorry but please keep your signature to 4 lines in length - MSE Forum Team 20 -
I made a claim to my bank for my charges they wrote back to me saying they would get back to me in 6-7 weeks which would of been the 12th July from the date i recieved the letter. I never heard anything from the bank and trying to contact them was useless. Now they have gone to court and all claims have been stopped til they have reached a decision. Im fed up as the bank was supposed to give me a decision before they went to court does anybody know where i stand with this as i feel the banks just fobbed us off knowing they was going to court and would'nt have to be paying back any claims until they had a decision.0
