    I made a claim to my bank for my charges they wrote back to me saying they would get back to me in 6-7 weeks which would of been the 12th July from the date i recieved the letter. I never heard anything from the bank and trying to contact them was useless. Now they have gone to court and all claims have been stopped til they have reached a decision. Im fed up as the bank was supposed to give me a decision before they went to court does anybody know where i stand with this as i feel the banks just fobbed us off knowing they was going to court and would'nt have to be paying back any claims until they had a decision.

    i'm in a similar boat with TSB and Abbey. I have recived my statements and sent them all back, i keep getting letters saying "we are sorry, it's taking longer to process your complaint that usual" etc etc.. They are simply stalling the process. is it worth filing the court form or not??? :mad:

  • Nope is the answer Johnny, the bank may well look to get the case set aside while the test case is being heard, but you can contest it as well. As it stands today, the judge must decide whether the case goes ahead or not.

  • Personally, I would get an N1 form from your local court, as I am not a fan of MCOL as you are restricted by the number of characters you can use.

  • does anyone know if i will still get my money? i sent off the letter saying yes i will accept 815 quid from barclays 10 days ago and now they have frozen all claims does that included mine? its all signed sealed but not delivered?

    MCOL and taking the bank to court can be a long drawn out affair in normal times (as mine has been - MONTHS to get a court date, which will now no doubt be stayed).
    If you wait for the outcome of the test case, the FO will then start dealing with claims again and that process is a whole lot quicker (and far less stressful) than taking it to Court.
    Taking my claim against Natwest through the Courts was the biggest mistake I ever made
