Yep - meant to say I'll be sticking around here and on PPP. Hopefully I can repay some of the huge debt I owe a lot of people (before they issue an N1 claim).
Since this started, I've helped with two POPLA successes and 3 initial appeal successes for friends and colleagues so I guess I'm hooked0 -
Well done bluetoffee! I hope mine follows the same route!0

Next task is a schedule of costs to the court. I'm not letting them get away with this
Do not forget to claim for the new Saville Row suit you ordered. You never know how far you can go until you go too far.0 -
So our initial celebrations were a bit premature. They actually paid the hearing fee at the very last minute.
We have spent the last couple of weeks getting everything together in preparation for our hearing today.
So we rolled up to Liverpool Civil Court this morning (lovely day to be in town btw).
Spoke to a nice man at the court who informed us that the claim had been discontinued. He showed us an email from DEAL that the court received at 15:40 yesterday. Unfortunately they failed to let us know (along with all the other info they didn't send us).
He also mentioned an earlier case that was also discontinued.
I informed him that this company was behaving in this way all over the country and using the court system as an unofficial debt collector.
If I understand correctly, we can now go for our costs due to their unreasonable behaviour and the fact that they discontinued at the last minute.0 -
Of course, your costs have escalated, too:-)
- unnecessary travel
- £18 p.h. prep. costs, given 'We have spent the last couple of weeks getting everything together in preparation for our hearing today.'

Good news at last bluetoffee1878! It's over and you do indeed need to apply to the Judge immediately for your costs for wasted time (wasted a day's holiday from work?) and expenses.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If I had known then I would have tagged along for a pint afterwards seeing as it would have been on expenses :rotfl:

Thanks bluetoffee - that kept me on the edge of my seat for half an hour reading through the whole thread!
I came on here a couple of months ago for the first time for advice with a PCN which has now been resolved thanks to all the good advice and links given by the lovely folk who live in this forum!
Just goes to show, as long as you take time to educate yourself, have a bit of tenacity and and a determination NOT to be hoodwinked by these barstewards then you can beat them.
I'm amazed at the number of people who shout for "desperate help" and then give up before they've even seen the first hoop, let alone jumped through it. Don't know why they bother to come here in the first place if they pay up after five minutes.
In honour of your great thread I shall be opening a bottle of vino right now and raising my glass to you.0 -
Quick update for completion:
We sent a letter to the court claiming costs and a schedule of those costs. Much thanks to Mystery 1 on legal beagles for the template costs letter.
The court have now copied us in with a general form of judgement or order stating that: Unless DEAL contest the costs claimed then they will be ordered to pay up. The deadline has passed now and I'm not sure as yet whether they did or did not contest. When I get confirmation from the court, I'll post up the result.0 -
Well it's all over
I guess DEAL/CEL didn't, wouldn't, couldn't contest our claim for costs.
Now received a letter from the court stating that:
IT IS ORDERED THAT
1) There be judgement for Defendant for costs in the sum of £201.56
Looking forward to receiving a cheque from DEAL/CEL, and I'd like to say it's been nice doing business with you.
Because of this I've now managed to help other people with several Initial and POPLA appeals and have a 100% record so far.
Big thank you to all those that helped and supported along the way.0
