We have received a reply from the court after complaining to them regarding not receiving the DQ from DEAL and about Mr Shwarts and requesting that they strike out the claim. Reply is as follows:
It says in receipt of your letter, the file was referred to a district judge who made the following comments: "the matter remains in the list on the XXth XXXXXX 2015. The defendant will need to make a formal application if she wishes to apply for the claim to be struck out"
Please find the relevant application form which must be completed in duplicate and the fee to issue the application is £155 unless you are eligible for a remission/part remission.
I'm wondering whether to write to DEAL requesting a copy of their DQ and to the court requesting a stay until after the test case with DEAL and co-op
Any thoughts anybody?0 -
What might happen is if they turn up their brief attempts to be-friend you, dumps some paper work on you and laughs in your face when you take it.
Sit in the waiting room and do not take any paper work from anyone, anything they put near you leave it where they leave it, move seats if possible.
If you can seal your evidence bundle in string preferably red in a cross and tie at the top.
Only open it in front of the judge.
Those that know how courts work will know why you enter with a tied off sealed bundleI do Contracts, all day every day.0 -
Progress so far - Nearly at the end I guess
Written further to the court re lack of DQ (or anything else for that matter) from DEAL.
Also let the court know about the recent events being blogged by The Prankster.
What I would really like help with though is I have finished my latest draft of my skeleton argument with various bit s of help from various sources here and eleswhere.
Is anybody available to have a look at it and advise/critique.

Still no DQ from DEAL and they did not pay the hearing fee.
Two letters and two phone calls to the court to let them know such
Last call we mentioned the cases blogged by PP and they seemed very interested, so have now written a third letter to make the court aware of those cases recently struck out.
Court have given a new deadline for DEAL to pay which I guess they won't (unless its in Scottish pound notes), and I'm hoping the court strikes the claim when they fail, or when the court make an order similar to the 3 cases on the pranksters blog which they will also fail to comply with

:beer: Well would you believe it? It appears that DEAL decided not to follow the order from the court to pay the hearing fee.
Phoned court today and they inform me that the claim is struck out :j
Not celebrating too much until we receive the official notice from the court.
Next task is a schedule of costs to the court. I'm not letting them get away with this
