Further thought on this, if CEL now no longer have a contract to manage co-op car parks as of Fri 19th Dec (yesterday) as stated by Deborah, if the equipment is still operating collecting customers number plates would this be a breach of any act or law?
Also I tried to use the FOI act to get co-op to send me the contract with CEL but she said that "The Freedom of Information Act applies to requests made to public bodies, and hence is not applicable to Co-op."
Anybody clued up enough to know if this is correct?
Really got the bit between my teeth now they're not getting off with this so easy.0 -
When I asked Co-op for a copy of the contract, I was told that their contracts with third parties are confidential. Saying that, they also told me that "assignment is allowed" when I asked whether CEL were permitted to assign the debt to DEAL - given that they now state that assignment wasn't sought or permitted to those that have asked since, I wouldn't trust a word they say!0

In preparation for the full defence that I guess I will have to start putting together, is now the time to send a part 18 request to DEAL?
Sorry if this is obvious but I'm in uncharted territory for me now.
I guessing I ask for the contract, NTK, Signage, case law they will be relying on, anything else .....?
I don't suppose anything will be forthcoming from DEAL so is it better to make the request to CEL?

DEAL and CEL are the same...or at least the address they both reside at are the same...so you can send the part 18 request to both.Dedicated to driving up standards in parking0

I believe Part 18's can only be sent to the other parties involved.
If I were you, I would use the statement from Co-op (in your skeletong defence) to refute what DEAL say in their witness statement about assignment being allowed, and include a copy of the email in your evidence bundle. By doing that, you're automatically casting doubt on their statement.
I'm not convinced that the Co-op will give you anything more than what they've already said, so I'd let them go for now and concentrate on pulling all of your documents together ready for submission to the Court and DEAL. If it would be helpful, I'm happy to send you templates based upon what I used for my case with CEL - there's a witness statement, a skeleton defence and an index for the evidence bundle. Hi all,
first off happy new year to all the helpfull people on hear and a very unhappy year to all you PPC scamsters.
One question, we have not received a copy of the DQ from DEAL although we served ours on them. Wasn't really expecting anything off them. So do we contact the court who issued the claim form, or wait until the hearing is allocated to our local court and we get a hearing date?0
