Modern Day Highwaymen

Hi all.
I like many have now received 2 parking fines, my partner also has received 2 on the same day from the same location/company.

We have received them from Parkingeye and where issued them for overstaying in a Sunderland hospital dropoff/pickup point. I'm sure many of you will have been through this. I have been reading many of the posts here but I cannot find a template of a letter I could send to these modern day highway men. Forgive me all as I'm sure there will be 1 here somewhere but I am very limited in tech stuff (its took me 1.5hrs to get registered on here:rotfl:). Yes I suppose we are both stupid and ignorant not to notice the signs stating there is number plate recognition cameras at the hospital but I did see the sign stating a 20 min limit. I would of liked to have been able to leave the parking space within the allotted time but unfortunately this was made difficult by the big white ambulance parked across it. Now I suppose I could of asked the driver (who was doing his job picking patients up just like me) to move quickly before I got a ticket, but no I just waited patiently like any decent person would I presume. Needless to say 8 mins later when I did manage to move it was to late :mad: At this time I did not know that there were cameras on entry and exit so never really thought anything more about it. So much so, that later on the same day my daughter who had been released(this is my 1st ticket) from the hospital after having her tonsils removed was rushed back in via Durham hospital and then an ambulance + Blue lights which I followed in my car. I didn't think twice where I parked my car well no that's a lie as I didn't park directly behind the ambulance or obstruct any emergency exits or the like just in an empty space to which there was many (late at night ) in the drop off area of the main entrance which is next to the A+E dept. I then run straight to the Ambulance to get to my daughter who was alone for her journey as I had to take my car or it would of been left at Durham Hospital where I'm sure I would of also received a parking fine if left over night. I,m sorry if I,m rambling on but I just wanted you all to know just how bad a day my family were having:angry:. A similar course of events happened to my partner who was chasing our daughter around the north east hospitals, but I think I will let her voice her opinion if she chooses to do so:mad: lol.

Well if I haven't killed you off already can you please advise on how to get these unreasonable fines to go away. After reading some of the posts here and elsewhere I don't feel confident of going down the mitigating circumstance route. Please HELP

    I've not read it being such a wall of text although I suspect the advice will be the same as to all other newbies - go read (and digest) the NEWBIES thread at the top of the parking board and come back with any specific questions.

  • I have tried to copy and paste into the Reason for Appeal box on Parking eyes website (appeal section) but it will only allow a 3000 letter string? Any advice please. I dont really want to remove anything to make it fit, As I said earlier i'm really bad with tech stuff
  • Shorten the 'The purpose of this communication is threefold:' part so it fits. The document comes in at around the 3000 character mark (with spaces) so won't need too much compressing.

    You could copy the text into Word, highlight the text then use the 'Review' - 'Word Count' feature (also gives 'character count with spaces'). Fiddle around with it until it lands under the 3000 characters.

    I have just tried to do this but the character count comes in at 4786 with spaces and 3941 without. I'm not sure on what to delete???

    ezzerscrooge it looks like I may have possibly copied to much could anyone advise please? I copied from Dear Sirs to Yours Faithfully so I presume thats correct???
  • Can anyone help me please? Is this the right way to go?

    I have now decided to send the appeal letter attached as a file as I cannot decide what to remove to bring it below 3000 characters as I'm bound to remove the wrong words or sentence.

    Also On the parking management appeal page it requests the info, am I the keeper,driver,both or none of the above, should I put none of the above or the keeper as they already know I am as I received the PCN by post. It also requests my name and address do I give them this? although it probably wont send the appeal unless there is something in the box.

    I know I must be a drain on your valuable time but please help as I don't want to give them money for 1 ticket never mind the 4 I have received so far. And again I apologise for my stupidity but I havent got a clue on what or how to do this even after reading the "NEWBIE PAGES" My heads spinning:huh:

    You seem to be struggling with this, and between you and your partner you've got 4 charges to deal with.

    The following organisation will deal with all this for you and will guarantee a successful outcome. They charge £16 per ticket and will do everything. £64 might seem a lot to shell out, but a lot cheaper than 4 x £100 and doing all the work yourself, which you seem to be having trouble with.

    Or is this just not another company praying on the illegal actions of another company.

    This below is at 2475 characters (including spaces). Fire it off to the PE appeals system.....

    I challenge this 'PCN' as keeper of the car, on the following grounds:
    a) The sum does not represent a genuine pre-estimate of loss. It is a disguised penalty and not commercially justified


    b) As keeper I believe that the signs were not seen, the wording is ambiguous and the predominant purpose of your business model is intended to be a deterrent


    c) There is no evidence that you have any proprietary interest in the land


    d) Your 'Notice' fails to comply with the POFA 2012 and also breaches the Consumer Contracts (Information, Cancellation and Additional Payments) Regs 2013


    e) There was no consideration nor acceptance flowing from both parties and any contract with myself, or the driver, is denied


    f) Your ANPR is not maintained or in correct working order. Furthermore the system is not operated in a reasonable, consistent and transparent manner


    The purpose of this communication is threefold:


    1. Formal challenge


    There will be no admissions as to who was driving and no assumptions can be drawn in the absence of evidence. As such, you must either rely on the POFA 2012 or prove beyond any doubt who was driving - or cancel the charge


    2. ''Drop hands'' offer


    I calculate that we have both incurred some nominal costs - under £15 – so this is a formal “drop hands” offer. I remind you of the duty to mitigate any loss, so withdraw the charge within 35 days without further expense and I will not pursue you for my costs



    3. Notice of cancellation of contract


    I hereby give notice of withdrawal from this alleged contract which was never properly offered or explained by you. The charge is not acknowledged, is not due and no 'service contract' from you was ever expressly requested by the driver or by me. Neither the driver nor myself gave 'prior express consent' or any consent at all for any contract to exist. This 'contract' is hereby cancelled and any obligations now end


    This constitutes the entirety of my challenge and nothing further will be added. You must now, within 35 days, EITHER (i) accept my challenge and notify me that the charge is cancelled, OR (ii) reject my challenge, send me a POPLA code, and suspend any collection activity pending my POPLA appeal


    This is submitted online so I have kept a copy and this communication is clearly received by you unless proved otherwise. I look forward to your reply within 35 days and urge you to accept the drop hands offer and accept that I have cancelled any 'contract' because this resolves the dispute without cost
