Bought a Used Car TODAY
i've just purchased this afternoon a used car from a dealer..
Pug 308 -1.6HDI, '57' plate
whilst driving it i've had a engine management fault come up on it, now i'm going to go in tomorrow and ask for a full refund, as i'm not happy with this at all after a supposed 'service' before i purchased it.
firstly i need to ask, how likely is the dealer to refuse the refund? and what steps can i take to ensure i DO get refunded the money.
secondly, i paid for the road tax for a year on the car... will i be entitled to that back as well?
thirdly, if the dealer flat out refuses me a refund, can i use visa chargeback and leave the keys and car with him?
i'm a total noob at this and i can see me not sleeping all night with worry...
help me moneysavingexperts... you're my only hope :P

surely i'm entitled to it, under the sales of goods act the car isn't
a) of satisfactory quality
b) first for it's intended purpose
c) as described
based on the fact the car was purchased less than NINE hours ago, i can't see how he's got a leg to stand on when it comes to refunding me the money
but if he does that's where my visa chargeback question comes in, i'll leave him with a rejection letter, the keys, documents and then surely i can initiate chargeback on the vehicle via my bank ?0 -
There are no grounds to demand a refund. You must give the dealer the opportunity to rectify the fault.0

Depends on the fault, if it's something minor then they could easily and reasonably correct that. You're right that the vehicle has to be of satisfactory quality, fit for intended purpose and as described. It's also questionable whether the service was done properly given the engine management light.
If it's something more significant then you may be within your rights to reject the car provided they don't provide a permanent repair (removing the engine management light bulb doesn't count as a permanent repair ). If you're left without the car I'd ask for an equivalent courtesy vehicle or if unavailable ask them to provide a hire car so you're kept mobile.
I'd take the car to one of the chains (Halfords Autocentre/Kwik Fit) after confirming they'll do a free diagnostics check for you without obligation to repair there and then. That way when you go back to the supplying dealer you'll know whether they're being honest with you.
You do have the right to approach your card provider. They'll want evidence though so do make a note of phone calls and meetings with staff at the dealer.0 -
Does this model have the dpf regen fluid?
You should be able to reject it, but the dealer may want to read a fault code first.
Might be a simple fix or a bigger job like dpf/egr.
Most likely the dealer will want to try to repair it - so depends what guarantees they offer and what their attitude is like.0 -

yeah this is the salesman who upon meeting him told me 'i wouldn't by a french car they're always full of trouble... then saw we had pulled up in a 407' i can safely assume what the attitude is going to be like0

on the grounds that the depollution system is faulty, making the car unroadworthy.
i'm then legally entitled to reject the vehicle and ask for a refund.
i'd rather he just refunds it, but if i have to take it to court i will0
