  • Just a little update for anyone interested. DVLA have contacted me and asked for the evidence i was sent by mistake. So hopefully action will be taken against VCS.

    just a quick update,

    i got an email from POPLA for one of my cases and they have dropped it AFTER my rebuttal towards the pre-estimate of loss for a few reasons. one being it was headed with a different company all together XD

    "the issuing of the parking charge notice may be held to be an initial loss, in this circumstance the car park is free and therefore there is no initial loss. The Operator has not shown that the Appellant caused a loss to themselves or the landowner by parking without displaying a valid ticket or permit."

    i forwards the email from Xercise4Less with the rebuttal about all PCNs being void but they didn't comment on that only the ONLY reason its being dropped is on the grounds of the pre estimate of loss, which to be honest i don't understand why they didn't send this in the first place instead of me having to send a rebuttal. there was a change in circumstance so thats a bit strange.

    As for my second one im still waiting to hear about no doubt they will try to take it forward but now one has been dropped under the same situation surely they can't be that stupid.

    To finish off i am wondering how much will this cost VCS now POPLA have approved my appeal?

    POPLA appeals cost the PPC £27 each time (plus the BPA about £100 I think).
  • mine came through today - its quite funny as they put someone elses details in my popla evidence pack - as follow:-

    Reasons for the Assessor’s Determination
    It is the Appellant’s case that the parking charge notice was issued incorrectly.
    The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were.
    Accordingly I have no option but to allow the appeal.

    Had a response off DVLA - smacks of not wanting disrupt an income stream to me....but i tried and ive lost interest now. Email response below:-

    I have now received a full response from Vehicle Control Services in respect to the provision of another motorists data.

    I have received confirmation that the data was included as a result of human error, which was missed in their process of checking data.

    Vehicle Control Services have set or will shortly send you a letter to explain the error, they will also be writing to the other party involved to inform them also.

    The Information Commissioner has been informed as is the requirement for companies registered with the ICO.

    As the DVLA is satisfied all measures have been taken to rectify the issue and there was no deliberate attempt to misuse data, no further action by the DVLA in this instance.

    Please accept my thanks in bringing this to my attention.

    I literally reported VCS to every one and have been fobbed off by them all - ICO told me they would write them a strongly worded letter..ooh Scarey Monsters!!
    Sigh...at least i had fun winning all 5 of my popla appeals, you have to enjoy the little things!!

    It just goes to show there all in it together uptight each others butts, as they are all whiter than white on paper, i bet rip off britian could have a hit with this topic.
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:
